I thought by putting CHEN under EEA regulations, one will not be able to get ILR after 10 years on CHEN because ILR is based on leave to remain and not residence or derivative residence under the EEA route??

Wouldn't it be difficult to show that I am dependent on my children as they have been dependent on me and members of my household and not the other way around?

Thanks for your reply. My immigration advisor thinks I can apply for a residence card next January when my daughter turns 18 even though my CHEN visa will not have expired yet. I have already read the Zambrano ruling and even though it is positive, UKBA hasn't changed its rules regarding CHEN yet and I don't know if it would! It seems under The Chen ruling(ECJ C-200/02) the ruling did NOT state that the EEA national child's parents would have a right to reside as a 'family member' as defined under EC law.
