Yes, I looked at your queries, and can confirm what I have said is correct. She is on her own Tier1 and not your dependent, and thats it.

Yes, none of the parties have a right to live in UK as such, so its tuff. No one can rule what the exact outcome will be, but the chances are slim, to say the least.

I think I have found the answer. Absences for the duration of 3 months or more, and total absences amounting to 6 months in total= straight refusal. If someone wants their solicitor's help in making application they can do so and still apply through NCS. Its not that if you use NCS your can't take help from a solicitor.

He must disclose all information correctly to Housing benefit or any other tax credit or other govt dept, otherwise it could be regarded as benefit fraud. He is elgible to apply for any services/benefits that he is entitled to. His overstayer wife will not be a hurdle for him in any way.

You can't include her in your application form as a dependant because she is over 18. A separate application form needs to be sent for her, and offcourse a separate fee.

Also please note that your wife's eea4 application is still with UKBA. Withdrawl of passport doesnt withdraw the application in eea cases.

As you entered UK before 1971 immigration act came into force, you definately have at least ILR in UK. You said that you entered on your mother's passport.
