No, you have to meet the 3 year residence requirement for citizenship based on marriage to a UK citizen.

How is it possible that she has ILR for 1 year yet no residence for 3 years? ILE? Married and living abroad for more than 4 years?

This is a very routine situation and has been much in the news recently. http://www.bbc.co.uk/news/uk-11186397 I doubt very very much if it will affect your citizenship application. So please don't worry about it. HMRC are going to collect the underpaid tax through your future salary and seem to be ...

On what basis were you applying for a British Passport? Naturalisation with certificate? If so, and your mother is a different nationality living in a different country it really isn't going to matter that you got her birthday wrong the passport application form. They will have no records. So I woul...

Please don't worry about this. It will not affect your naturalisation application. When the application mentions taxes etc and asks for records this is for people who are self employed or have their own business. However, as you say you will probably owe some underpaid tax. As your second job starte...

You can apply now.

If you are married to a UK citizen you can apply as soon as you have received ILR if you have lived in the UK legally for 3 years. You have.

Your absences are well under the allowed 90 per year.

All the best.

So are you either already on a marriage visa or have FLR(M) issued in the UK and are nearing the end of 2 years? If so, you are correct, you need form SET(M). You don't have to list absences from the UK and unless they are very long which they aren't, they won't even be looked at. You don't have to ...

Please don't be put off from applying. You may be successful. If your wife could build up some savings (or already has savings) these can be used in support of her application. Also her job prospects will be considered, she could print out job advertisements that she would qualify for in the UK, or ...

Apply through the NCS (Nationality checking service). Your local council or one nearby should provide this. Do a search for it. For a very reasonable fee they will check your application and supporting documents, take photocopies and fees and you can then keep your originals - passports etc.

After another 12 months.

Because you are no longer married to a British Citizen you cannot apply immediately even if you have lived in the UK lawfully for 3 years.

Hi I've had a look at some of your previous posts to see what type of visa you are on. Husband on spouse visa, wife British citizen, right? OK. It doesn't matter that you have not been working for the complete 2 year period. For ILR on spouse visa you only have to show the last 3 months payslips and...

Don't panic!! I would actually be surprised if anyone got an appointment today. The reason being the date that would have opened up for appointments today would be Monday 31 August which is a Bank Holiday and they will be closed. This is the date exactly six weeks from now. Try again tomorrow for Tu...

Personally I think you will struggle to get ILR with this little evidence. Do you really have nothing else in her name. Junk mail? Anything? The problem is you will also need evidence of 2 years cohabitation to apply for FLR again. You will need the letter from your mother confirming that you have l...

If you have more than 6 I would provide more. You can also provide letters addressed singly from other sources to bolster your evidence. Although the form says 6 from 3 sources some people have been asked later to provide more evidence, so if you have it now, supply it, they may process your applica...

Yes you can make an appointment on her behalf as long as you have all her details. Susi on UK resident forum booked for her husband. It is vital that you call as soon as they open as there are very very few appointments for 10 year long residency. You may have to keep trying over a number of days. T...

No you do not need to include details of your son. As you say he is a British Citizen with British passport. He is not applying for indefinite leave to remain as your dependent and there is absolutely no need to include his details on the form.

It is very very hard to get an appointment for ILR with dependents. They must have very limited numbers of these appointments. Also read section 5 of the SET (M) form. You will need a letter from a doctor's letter or evidence to say he can't take the test or study for ESOL.

There is much cheaper alternative than going to a solicitor to certify a copy of your deeds. You can get an official copy of the title deeds from the Land Registry for only £6.
