The applicant must have been present 5 years ago to the day the application is recieved at the home office. There is no discretion over this issue. Since the fine was not issued in court I'm not sure this is considered a conviction and in anyy case I think you stand good chance. Azad, You are wasting your time. No one will be able to provide you with certainty either way. It will be up to the specific caseworker.

If you disclose your offence (as you should) the worst you face is loosing your application fee. Otherwise, wait for 5 years when the fine/conviction gets spent.

John - the OPs children were born outside the UK and he was askking whether he can apply for them before he applies for his or his wife's citizenhip.

I thought that the answer tot hat would be that he has to wait until his application and use section 3(1) for them.

The problem is that in most cases the NCS ask you not to leave the UK for a working week (at least 5 business days) after you apply to make sure that you're in the country when the application is recieved in UKBA.
