You should wait at least 6-8 weeks, my appeal was allowed on the 28th of May, and I received the call letter a month later, and the visa 2 weeks after that, though they say up to 6 weeks. Your solicitors should be helping you in chasing up HO to issue you a visa, they have the contacts within the HO...

No, long absences only affects your immigration history if you are claiming for long term residency. Otherwise, it doesnt matter, many people leave and come back and spend long periods away from the UK, but they do not apply for residency. You are probably right about the 6 months, I wasnt sure, tho...

I disagree on the point that long absences affects your immigration history, there is no immigration rule that states that they only say that if your circumstances change (i.e. no longer a student, want to work rather than visit etc) then you need to reapply for another visa, thats standard. Many pe...

They will always ask questions, I think the main point is to be calm and confident, at the end of the day they have granted you the PSW. I dont agree that leaving for long periods is negative on your immigration, it only means that you may not be eligible for long term residency, since they require ...

Hehe whoever gave you that info is wrong, you just need to send you passport, and pictures to be safe, but infact it seems like they keep the pictures from the first time you sent out the passports.

Yes, though not always, in my case the HO didnt attend the hearing, though it was a straightforward case. You have 28 days from the time of the appeal refusal to leave, but have faith, things could go well!

Its understandable that you are panicking right now, after the first time, but I think you are panicking too much. I thought what they mean is that you can submit evidence to prove that at the time of applying you met all the criteria, but you cannot submit new evidence that covers you from the time of application? It is interesting if they remove that rule, because the burden of proof is on the applicant to pro...

UKBA states that after 6 weeks you should check the progress of your application. The average time for straightforward applications seems to be 4-6 weeks, but at the same time some have taken months.

But why do you need to certify them, yet for normal applications you only need to write your name on them? You can certify them to be safe, but I highly doubt that you need to certify them, they probably mean you need to write your name on the back.

Hi, Have you contacted the Home Office Presenting Officers Unit? Their number is 02089172039, they will let you know where your case is, the AIT has to work on your file after the 5 day period where HO can appeal. Hi, The Home Office has some cheek, if they didnt attend the hearing, then clearly they initially saw that they were in error. The only thing you can do at this point is wait, because as the appelant for a review the home office would have to withdraw the appeal for you to do a fresh application. I ...

No you cannot withdraw it unless your current visa is still valid. You should talk to an immigration specialist, there may be a way but I dont think so because you need to be on a valid visa, withdrawing it means that your current leave will expire.

Re: What would be the VISA start Date Once Appeal is ALLOWED

It starts from the date they endorse it in your passport. So if its taken 4 months to get the passport stamped, it will start in the 4th month. Dont worry. Also I have found out that you need to contact the Special Appeals Unit to action your file so they can forward it to the HOPOU. Sometimes they ...

Re: Almost 28 days and still not have a result from hearing!

Hi I agree, first of all there have been delays in the appeals process recently, so the decision will probably take longer than usual to reach you. If its taking almost two months from submitting the form to having the hearing date, it may possibly take longer than 28 days, so hang on tight, they ar...
