Thanks for the update, fbd. You are doing this forum and other applicants a great service by sharing your experience, as I am sure there are countless out there who need to appeal and will have to go down the same route as you have. It would be great as well if after you hear back from the AIT you c...

Just relax and allow a good 8-10 weeks before you start worrying... they are hugely understaffed with a massive backlog and how long your application takes is all down to luck. In fact, I am of the opinion that the less people chase everyday for status updates, the more resources UKBA can dedicate t...

I was under the impression that for an appeal, you are not allowed to introduce new evidence (i.e. another bank statement for another account).

Or is that allowed for maintenance fund appeals?

The provisional certificate problem is solely to do with your university; hence only the registry department in your university can help you out with that. Unfortunately that is just the way it is... the system sucks, but we just have with it. One thing you can do is that you're entitled to work ful...

Exactly, many companies use external payroll managers.

Just make sure you have your pay slips from KFC with your name. Your right address and NI number on the payslip will be good too.

Its definitely been in for way too long if still waiting from November 2008. Was your application complicated or special in any way?

All I can say is keep chasing and waiting... there is probably nothing you can do except make an official complaint about the time taken.

As you cannot introduce new evidence in appeal, no matter which statement you show you will fail the appeal. The appeal is only there to appeal against errors made by the caseworker in evaluating your documents/evidence in your application. Since your application will clearly show you didn't have mo...

I really do think 6th March to 5th June is 3 months. They can't reject based on that as most bank statements will be from x date y month to x-1 date y+1 month.

Your document already has the following:
The above FDR is ENCASHABLE Immediately on demand by the depositor.
Which I take to mean readily available? I think in a court of appeal that will hold up as meaning "readily available".

I am with boonkoh here.. you are either against both financial investing and skill betting, or you are for both. The principle of both is the same, just that the media/government/etc make it seem like they are so different. In fact, even working in an honest 9-to-5 job is a bet. You are betting that...

all i can say is just keep ringing up to check availability... and make sure you have your docs all ready to go down on short notice as I believe most cancellations will occur less than a week before the interview date due to unexpected circumstances.

Why would the second condition prevent you from a successful extension application in 3 year's time? As long as you DON'T work as a doctor in training in the UK on your visa, you won't be breaching any rules regarding that clause. The fact is that not all university degrees are equal and in many par...

I do think the form is asking for your net earnings (as I remember when filling out mine I had put down my gross salary for my job, instead of the net after tax). Dividends in this country is paid net of 20% tax (i.e. 20% tax is automatically taken from the dividend issued by the company before it i...

So each of the Tier 1's (e.g. General, PSW, Investor) are all considered a different categories....

Does this also apply for the 5 years in the same visa category that is needed to apply for Indefinite Leave to Remain? Or does the HO count all Tier 1's in the same category for this?

It took my friend 2-3 extra months to get his appeal sorted and get his visa.

I think now there is an even greater backlog due to the huge number of applications in end-March.

As mentioned above, you'll definitely get your visa in the end, as during appeal just £1 short will be accepted. During the application process it will be at the discretion of the caseworker. Also it depends on how fuzzy you meet the other requirements... if the caseworker has some doubt about othe...

I don't think the amount of money earned is an issue... as different jobs pay different amount. But as yours is a commission based one you have to definitely prove that you only worked 20 hours a week and that it was commission and hence the variable earnings month-to-month. The contract you mention...

Time taken to approve depends on how many applicants in that local office plus how many staff working there. But I do agree that chance of getting approved in the UK is much higher if all your docs (bank statement, payslip, study, etc) is from within the UK. It takes so bloody long because there are...
