Technical question about ILR application

Hi, I am about to reach the 10Th year living continuously in the UK and am planning apply for ILR. Occurs that back in 2009 I made an in time application for a tier-1 visa which was declined. I straight away appealed to the decision being granted automatically 3C leave. About 6 months after while my...

Thanks for the information. You are correct 3C and 3D leave to remain work towards the 10 years long term residency however the guidance also says that a person is not entitle to submit a fresh visa application while the outcome of an appeal is pending. They don't show any case example similar to mi...

ILR QUESTION - 3C leave related....

Hello, I wonder if someone can guide me here: By the end of the next year I want to apply for my ILR as I will be reaching my 10th year living in UK. I have been reading HO information about the requirements however the details sound a little confusing. At the beginning of this year I went through a...

Re: appeal vs fresh application

If you have given the right to appeal you are not an over stayer but you've been given a 3C status extenting your stay until the outcome of your appeal is announced therefore technicly you can submit a new application to HO. Like I said before in the end is down to the HO case worker's discretionary...

Re: Help

I didn't spend much money as my case was led by IAS which is partly funded by the government. If you can prove having a relatively low income they charge you almost nothing. Just keep appealing and while your case is at the high court submit a new application meeting all the requirement. In the end ...

Please tell me if this was your initial application for PSW. I am told that IGS applicants can not re-submit their application if it has expired. I am appealing my transitional visa refusal. I don't think you are an overstayer since HO gives 28 days to leave the UK once you last appeal is dismissed. If i were you I'd send a fresh application as you don't have much to lose at this stage. I'd suggest you to get advice of an immigration solicitor asap to launch an application by yourself. ...

Yes, launch a new application if you meet all the requirements but do it by yourself, don't use a lawyer. Now considering that your high court appeal was rejected am unsure what catgory of visa you have at the moment. I am currently going through a high court appeal having a 3C visa and last week ju...

Thanks Vineta, Very useful information. For what I can understand I currently hold a 3C/3D leave to remain while I exercise my right of appeal until the end which unables me to claim a 10 years long term residency should I reach the 10 years. Now out of time applications might not work for me as it ...

Thanks again Vinata, I recall having read a court determination where the appellant had archived to obtain 10 years in the UK by the time the court outcome was produced and therefore met 10 years of interrupted residency. He obtained its permanent residency. Thanks for your comments mate. I don't kn...

Ask your solicitor about an out-of-time application as well. There are some very good solicitors out there who specialise at such applications, so if you loose your appeal in all the stages, you can still apply for psw provided you can meet the criteria for it. It would then depend on the HO how th...

Is there any other appeal stage after high court?

Hi,

I am going through the last stage of my PSW high court appeal.
Does anybody know if there is any other court or entity where I can rise and appeal againts the HO determination in case this last one fails at the High Court?

Many thanks.

Re: PSW appeal reconsideration

Yes, i introduced new evidence at the hearing date however my savings account coudn't cover the first 2 days of the 3 months period where i had less than £800 in total. If you have new evidence that covers the full 3 months, show it and you'll appeal should be allowed by the judge. On the grounds t...

Do I need to register my new address with the police??

Wonder if anyone knows whether I should register my new home address with the police even if I'm going through an appeal process, considering that my police registration certificate doesn't have the HO stamp indicating that my visa has been renewed.

Many thanks.

Re: PSW appeal reconsideration

On the grounds that the 800 pounds should be a guidance and not a rule since the purpose of this is to confirm the applicant can maintain himself (i went down only for 2 days) The immigration tribunal only see at whether there was an error when you visa application was processed by the HO case worke...

Hi arif, I was wondering how your case is going? Did you apply for a high court review in the end? If so what is the process like in term of chances and waiting times? The AIT just refused my reconsideration application and now I have chance to challenge it by going to high court with my lawyer. I'd...
