Re: 3 Months Visa scheme for EU national to end on Christmas Eve

Implicitly or explicitly it must be targetting EU driver, as I cannot see a cross continental worker coming to the UK for a 3 months visa ending on the 24th December 2021. Cannot see drivers outside the EU being allowed to work in UK immediately with their foreign issued HGV. Well in the last 2 week...

3 Months Visa scheme for EU national to end on Christmas Eve

The Government has announced a new 3 months visa scheme for EU national to come in. The scheme will end on the 24th December 2021. The government will also be setting up a task force to ensure that those EU nationals who do not depart by the 24th December will be rounded up and forcibly removed. HGV...

Re: EUSS for extended family

Well the rules are changing in October. Therefore if in future the Home Office write in a letter that a person would have qualified for EEA family permit had it not been for the repeal of the regulations, that letter will be sufficient to apply for EU settlement scheme, without the need for an actua...

The law essentially protects existing relationships, save for future offspring. The law protects those sexual relationship that existed before exit day.

Re: Marrying UK partner resident in Ireland, currently non-EEA stamp 2 permissions

Thanks for this although it does not really state what I should include in that letter. INIS was also not helpful when I eventually got a reply. They told me I had to be a de facto partner with my partner prior to getting married and then applying for a residence card on the EUTR1A, if that makes s...

Tempted to say my thoughts on Brexit although probably best not to get myself worked up  Thanks again :) Brexit will remain in our thoughts for many years. I share your feelings. Maybe your wife should consider Irish naturalisation or apply for the UK Eu Settlement family permit. You will need...

If there is an agreement that the child should stay in UK and you have access to him, then you will have right to access.

A decision letter is sufficient. Registrations are merely a formality.

On the basis of section 9 of the 2004 Immigration Act , I am not sure I can accept that assertion as legally sound.

If my memory serves me right, i believe there has been rulings that both the centre of life test and the requirement that Surinder Singh sponsor exercise treaty rights upon returning home are unlawful.

Re: De Facto current processing times

Ok you clearly haven't dealt with INIS previously or checked out any posts here :) You should always multiply their expected timeframe by at least 1.5 - 2 for anything they say. When they say 6 months, your expectation should be 9-12 months at the very least in the best possible scenario. Things ar...

Re: EU citizen

The child ought to have been granted settled status.

The child can be registered whilst the mother will have to wait until she has acquired settled status and can then apply under section 6(2).

Re: From EU SS Family Permit to Pre-settled Status. HELP!

That is not correct. As your wife needs to have her biometrics done, you will have to book a biometrics appointment, and it is to that appointment that you should take the passport. You must not send it

No need to send passport to Home Office. When you attend biometrics, they will scan and give back to you.

Re: From EU SS Family Permit to Pre-settled Status. HELP!

I think you may be right, it is not always safe to assume SS is Surinder Singh, upon further consideration, it appears that abbreviation is Settlement scheme. He can still use the online if that is the case, but has to enter passport details and undertake to send, but as this person will need a biom...

Re: [EUSS] Received letter that I'm illegal but I have settled status?

Normal country would recognise and abide by their international obligation. As i was writing, I noticed the UK is indeed seeking to breach its international obligation in relation to Northern Ireland protocol. At present the treaty is in our primary legislation, and it has direct effect in the court...
