you need to reside in the uk and exercise treaty rights (working - self employed or self sufficient)
u need to an address in the uk,,

and u cant be absent more than 6 months in one year..

if ur wife is a non eea u need to meet the above requirments in order to bring here and live together,,

Don't worry. All European application are first processed in a central location. It doesn't go to a EEA4 dedicated team. Well mine i sent odd documents proving 5 years residence, ireally hope the this team dont refuse it.. cus i sent credit report to prove 5 years residnce + court judgement for DV ...

continously living in the uk for 5 years - with an eea national spouse who is exercising treaty rights.. (to recieve PR)

unless the EEA NATIONAL is PR holder then you can apply for ILR after 3 years following the UK Law instead of the EU Rule..

can i ask you on what basis they allowed your fiance to work-- cus this is a good sign.. as i have a friend of mine who they refused thier relationship but after a month or so they allowed him to work, so they then applied again and within a month they sent him RC..

if you are family memeber of an eaa national you have the right to live and join your eea national disregarding any immigration past .. its against the law to refuse for any reason to do with your immigration history..

First u should have applied under EEA rule as long as your wife was in the uk excercising treaty rights. now you can do that but they may suspect that your marriage is a marriage of convinience.. but worth a try but if they refuse for this reason u can always appeal, but they cant refuse for 320 7 (...

so u sent the eu national payslips,, the best u can do so they cant reject it is to send ur eu letter of employment issued by the employer stating that she/he has been working siince until present day..

they cant refuse this
