We are 8 months away from "3 years of marriage". He did leave the UK for a few months to work in his home country (a friend got him a temp job) and he intends to come back to the UK before the 6 month period. I really don't want him to return. My life is much more peaceful now without him...

The 5 years period starts since u get married and u r not obliged to apply for a residence permit as u will have to show to the home office that u have been married to an Eea for 5 years and the Eea national has been excercising treaty rights for a continuous 5 years. If you apply alone, they just check list to see if you have provided all the required documents for the application. They don't examine the evidence, just that it is there. If you apply together with the EEA national, they will usually issue a CoA when issuing the relevant document to the EEA natio...
