i agree with zchay3e, clock will start again from the date you got visa extended after the gap
i think you have to show some serious reason for not been able to apply on time, e.g you were ill etc

Are you talking of the TIER1 application ? you mentioned work permit ..

it was workpermit when i applyed in aug 2008, this became Tier 2 later.

i was successfull in the Appeal and AIT hearing was on 20th January 2009 and
Determination letter Received on 29st January 2009

BUT

since then no one contacted me even for passports.
