Re: My gf (usa citizen) wants to move to UK

There is also the Fiance visa where you have to be engaged and demonstrate that you will be getting married while she visits you in the UK (venue reservations, family/friend invitations, clothing rentals, etc...). She would then have to leave after the marriage and before 6 months and return on a S...

Re: My gf (usa citizen) wants to move to UK

I read about this type ''Unmarried Partner Visa'' and it said that i just need to prove that the relationship is legit and that we are intending to get engaged or are already engaged and minimum income of 18600. But my question is, is it applying to anyone in the UK, or only British citizens ? as i...

Re: Residency Requirement Discretion

..it looks like they're supposed to use discretion and allow me to "re-delcare" the application date if necessary? I believe that particular discretion is only to allow you to move the date to a date where you meet the requirement. In your case, that's months off. I'm not sure the HO will...

Re: Residency Requirement Discretion

You are however cutting it in incredibly fine. Why the rush to apply in February?? I'm planning on doing some travelling this summer, which would put me over the residency requirement limit...which would push my application back even further. Again, is that important? It doesn't sound like you are ...

Re: Student visa overstay, 2 children born in UK, options?

Apart from overstaying (and working illegally) , has lived lawfully You missed a key critical detail which could even jeopardize a LR 20 years application, so I updated your quote. 20 year LR leading to ILR ten years hence seems a long time, The idea was to very heavily dissuade illegal immigrants ...

I just don't believe this loophole exists. That would be so obvious a tactic for employers to exploit as to be legally absurd.

Re: Confused with Good Character Requirement

I am not expecting any discretion being a spouse, I just mentioned " as as spouse of british citizen " because I dont have to wait 1 year ILR to apply. ILR and Citizenship are two very different things. Different rules apply and they are decided by different offices of government. For the...

Re: Confused with Good Character Requirement

Hi Admins, I would like to have your valuable advice for british citizenship application regarding Good Charactor requirement. Immigration History 1) Arrived UK as visitor in April 2006 2) Applied Asylum in May 2006 ( during 6 months visit visa) 3) Asylum and Appeals rejected/exhauseted in May 2007...

Re: Help/NTL application/suspended from work

Better yet, the lawyer should demand it, and the feedback should be directed at the lawyer. I disagree with your comments above and do not think that intervention of a lawyer is necessary. If the employee was simply dismissed then there could have been a legal case. That certainly is a broad shield...

Re: Help/NTL application/suspended from work

You should demand the HR to perform a check via Employer Checking Service to prove you have indeed the right to work in the UK until you get your documents in order as getting NTL/BRP can take a while. That should be enough for them to let you work legally. https://www.gov.uk/check-job-applicant-ri...

Re: Help/NTL application/suspended from work

I wonder if it makes sense at this point to pay the lawyer to write and mail an official letter without me being in the middle? Yeah that's the basic idea. Still situations like this can get awkward real fast. I'm not sure how carefully you want to play this. Then I think that they've just suspende...

Re: Help/NTL application/suspended from work

What do you all think of me being suspended without pay - an immigration attorney I spoke with said there was no need for this but my employer isn't budging - It's not right and it's probably not strictly legal (discrimiination based on nationality), but the UK government is using these kind of tac...

Re: BC referee is being nosey?!

Did any of you guys showed your passport to your referees? The question doesn't make sense! My professional referee was the vicar of my church where I'd (at that time) been a regular attendee for 7-8 years, am a regular reader, and was a member of the church council. The second referee was a family...

Re: NCS said I would get a Refusal of citizenship due to parking fines

Is this a legal ground for refusal and how Can I appeal Any grounds for refusal of a citizenship are 'legal'. Citizenship is a priviledge and the UK may confer or refuse it as they see fit. But I do think that in your case, you got mystifying bad advice on how to proceed with your application. Do k...

Re: Help with unclear rules for visitor

Just to be clear, your wife entered the UK with you and your family and remained in the UK for 5 months? Did you explain your circumstances to the Entry Clearance officer? Are you certain she was admitted as a visitor? Normally after two years outside of the UK, ILR lapses (as you seem to know), but...

Re: Sign my petition.

The UK can simply do away with the visas instead of charging anything for them. It is a sovereign nation and they can charge what they like, when they like, as they like, for whatever reason they like (including profit) or no reason at all. Most of the countries of the world don't have anything like...

There is no further advice except for him to apply and see how it goes. I'm assuming that T1E visa refused simply because of failing to qualify and no other reason such as deception.

1.how will this affect my stay or my status? It won't affect your status at all. 2.when we get married do i now become a britain citizen? No. Is the person you're marrying a British Citizen? 3.my papers expire in 2021 - will they be renewed? This depends on how you qualified for the status, in part...

Re: US born child to British by Descent Mn1 help

Before coming to the U.K. your husband must have applied for spouse entry clearance (did he?) and if so, was your son included as a dependent? ILR is not needed for section 3(5) registration but your son is going to need some legal basis to live in the U.K. between now and then if that's the direct...

Re: FLR(FP) 7 YEARS ROUTE HOW MANY APPLICATION NEED TO FILL

The only successful case I've ever heard of on another forum (couldn't dig up the topic, but will link to it when I find it) that I lurk in was that of a child born in the UK whose mother left for her home country shortly after birth (something like 3 months), leaving the child with a grandmother wh...
