Is the earliest we can apply based on 28 days before her leave expires or 2 years being in the UK

ILR following Fiance Visa

Please can someone advise.

My Fiancé arrived here on a Fiancé Visa in Jan 2011
She received her Spouse visa in April 2011 which expires in April 2013

When should she be applying for ILR. Is it Dec 2012 or March 2013?

Your help would be much appreciated

A decision could not be made on the day i submitted my FLR(M) due to discrepancies with the english test result.

2 days later i got the reponse in the post that my wifes Visa had been accepted!.

So i guess it does not join the postal queue automatically

The Visa is issued for 27 Months.

To fulfill the requirement for ILR ( Indefintie leave to reamin) your wife will have to show she has reisded in the UK for 2 years

Based on this your wife will need to travel within 3 months to ensure she fulfills her 2year stay in the UK
