Hi

I know that feeling.I waited for 5 months and got a positive result.Unfortunately there is nothing you can do.Calling the UKBA is futile as they will just give you a vague answer.My opinion is that if it was a straight foward refusal,they would have done it already.There is hope there for you.

You are not allowed to apply for child benefit.Your visa conditions include 'no recourse to public funds'.That applies to your dependants too.

Yes,they can access your NI records.They can easily estimate if you are working more the number of hours you are allowed from your earnings.If they want to verify, they will normally ask for your payslips,bank statement showing where your wages go and contract of employment.

I think your best option is to apply for extension on the basis of starting a new course and if asked for, indicate on the application that you are waiting for exam results of your previous course.That is the only way of getting a reasonable extension.

You need to appeal through a solicitor,but you will need good reasons to support why you sent your application after your leave to remain expired.

I have a theory about why some of these applications are taking too long.I think it is related to verification checks regarding the biometrics.The UKBA are verifying these details with the home countries of the applicants especially if you entered the country before they started taking finger prints...
