So the degree of absolute will define they are not in relation any more or is there any other evidence non eea member can provide that his EEA partner has left the host state and he/she can retain residence rights? because for civil partnership degree of absolute is not valid..

Jambo thanks for detailed reply. does this mean if eea member leave after 3 years and apply for divorce in an other eu state, non-eea member will lose his right of residence even she was exercising her treaty rights for over one year in uk? Thanks a lot Guru. On the safe side if I buy Csi now, will I be eligible for PR in 2015. Please keep in mind we have only Swedish European health insurance so far? Or do I have to wait until Nov2017 if I buy CSI now?

Thanks Guru for advice. She came in April 2009.

I am thinking to wait until 2017 and then I will be eligible for my PR on 10 years legal stay in uk . But not sure my working holiday 2007-2009 can be counted or not?

I have spoken with my wife and she is willing to come back to UK and agreed to register divorce case over here.

So In my situation do I have to have divorce? Is there any otherway e.g sepration etc to qualify for this category?
What I have to do in the meantime until I get the divorce. It might take years......

No she has been living with me from April 2009 to January 2012. . I believe if non EEA has been living 1 year together and relation for 3 years i can apply for retention right. Please correct me if i am wrong?

Thanks all of you for your valuable advice.

Just realised that his girl friend is 19 years old and I believe they can't get married in UK?

If they get married abroad e.g. Dubai etc would UK immigration accept this?

Dear benifa,

Do you mean I was not lawfully while I was on my working holiday visa? Could you please quote the reference to define lawful five years? So to qualify for indefinite stay in UK I have to wait another five years?
