This is just my opinion - my wife has her hearing on 25 Jan, I'm not working, on benefits and we are generally in a pretty poor position but have a lovely, happy daughter of 18 months who holds a British passport. We don't meet the "rules". Article 8 wise, we are a family, we can't return ...

I was told a 6 month wait. My wife applied in June. Got rejected in November. AIT appeal in January. I'm British. Our daughter is British. Go figure. UK immigration is nuts. Article 8, all the way.... This is all 2009, apart from the hearing which is in 2010, obviously.

Looking to the rules, yes, it appears to be. But the refusal is to a student visa when my wife's application was for an FLR(M). Appeal must be submitted Friday. Lawyer yet to be found. This is a nightmare.

On Thursday 5/11/09 my wife got the Home Office refusal letter and 10 days to appeal or leave the country. So we're appealing it. Their reasoning is that her original LLTR was for 6 months or less.
