A quick question
If the UKBA require further evidence/documents can this be submitted by the sponsor to an office in the UK for an application made abroad.

Building inspection report

I live in a two bed privately rented property. I am the sole occupant. My council tax bill shows single person discount. I have tenancy agreement. Since i am living alone and clearly another occupant would not result in overcrowding do i still need to prove the number of bedrooms through an independ...

Sponsor with dependent child

Hi, I am sponsoring my wife (to be) coming from Ghana. She has no children but i have a son aged 5. Do have to meet the higher income threshold for having a dependent child myself who is British. The way i read the form it is certainly a requirement if the applicant has dependent child(ren). Is it a...

Great, that is exactly what you need to do. After all, there is an entitlement, for the reasons you have stated.
Thanks for the reassurance John.
I will be going ahead with the appeal.

On what basis does the MS nurse say that your wife can claim Disability Living Allowance? Is she aware of your wife's immigration status? In UK law you are not an EEA citizen, you are a British citizen. Do you have a British passport ? 1/ Because she has become disabled due to the progression of he...

From the link you provided it states that ''public funds'' include Disability living allowance although later it states that an EEA national is allowed to claim but your wife is Ghanaian and therefore not entitled to claim May I draw your attention to page 4 paragraph a) and also the table on page ...

she is a family member of a UK citizen (me) and DLA is one of the exceptions to the rule and does not count as "recourse to public funds" when this is the case. Surely therefore, she has a legitimate claim and is not in breech of her visa conditions (two year spouse visa) Her ILR visa will...

DWP refuse claim despite legal entitlement

My Ghanaian wife has lived with me in the UK for 2 years. She has suffered from multiple sclerosis (MS) for a number of years but this has been manageable. When our son was born a year ago her condition worsened and she now has to use a wheelchair. The MS nurse recommended she claim disability livin...

I thought that was the case, thanks John.
I think it may be a good idea to send in his birth certificate as part of the proof we have a genuine marriage, otherwise UKBA wont even know he exists!
Do you agree?
Thanks, Ken

SET(M) Section 3 - Children under 18

My wife is about to apply for ILR after 2 yrs on a spouse visa. I am a British citizen. We have a son born in the UK who is now 10 months old. Section 3 of the SET(M) form states: "If you have any children under 18 who are living with you in the UK and who are applying for indefinite leave to r...

You can apply. UKBA may hold issue of her ILR until the two years is complete. You can still apply even if she had not come to the UK up to three months from the date of issue of the her two year spouse visa. Any longer than three months and you need to apply for an extension. So you are well within...
