Re: Subject Access Request

Hi all, I've requested my visa history for the last five years, and I received a letter showing that UKBA received my request on 10 April. Since then, I've heard nothing form them even though they mentioned that they would deal with my request within 40 days. Now I am wondering if I could enquiry r...

Nothing personal, but it's funny how the tone of some people changes, once they get their ILR/citizenship. Nobody here expects an easy ride- that's a straw man argument. Not sure if this was aimed at me - I don't have ILR or citizenship. I am in exactly the same boat as everyone else, but I don't s...

Stop taking things so personally. Some additional observations: 1. So firstly, the discussion is around entitlement to free care for visitors and temporary migrants (e.g. people who are not necessarily contributing to the country in the long term). 2. Much of the issue is not the actual entitlement...

ukswus, Please read the original draft, the text states that they want to restrict access to tourists and visitors , nowhere does it say immigrants. The NHS has an outstanding amount of over 40 million from people that are not eligible for this service. If they had paid up it would result in better...

The change they are asking for is to remove access for temporary visitors. Anyone here who is working legally and is paying NI will still have access to the services. Before cribbing about the NHS you should remember that it is still a service that works, albeit slowly. I am from India and anyone e...

Re: Free????

There is nothing free in this country for non eu migrants. You have to pay into to system for avg 5 to 8 yrs, before thinking about something. There is hundreds of hurdles before that anyways. NHS free???? Bloody nightmare. You can't stay in the hospital for a night unless you are dying!!! Go to GP...

Re: UK Exprience - for an extension

Question - does UK Experience only apply to NEW applications -- not extensions? In section K of the Tier 1 (G) form, it says: Before filling in this section of the form, you should refer to the Immigration Rules and the Tier 1 (General) of the points based system Policy Guidance. K1. You should con...

Some countries don't stamp anything on arrival, especially for their own citizens.

If the applicant has completed 5 years residence with total holidays under 180 days as was the case initially and has met the necessary points for the ILR, then there is nothing to worry about. It's cool that your solicitor thinks this way, but there is no mention of this either in the immigration ...

UKBA cannot be serious when they say that, retrospectively, no unpaid leave is allowed specifically for Tier 1 General. Even Tier 2 general, who are tied to a specific employer, have 60 day grace period between jobs which they can spend anywhere they want. And let's not forget the cost of Tier 1 Gen...

Re: Hi

I'm desperately searching for work in London right now to meet my income threshold and I'm wondering if I should just start looking for work abroad instead. I feel so incredibly defeated, after nearly 7 years of living here (4 on Tier 1). Before you do that, you may want to wait until we get more d...

hsmpil: this is interesting. However, note that they define "continuous period of 5 years lawfully in the UK" as residence for an unbroken period subject to paragraph 245CD . So while I think your interpretation of an unbroken leave is right, they still may refuse on the basis that continu...

Please read this under 245AAA (b) as per current updated rules, where it is clearly saying that for T1 (G) applicants are excluded from continuous employment. http://www.ukba.homeoffice.gov.uk/policyandlaw/immigrationlaw/immigrationrules/part6a/ (b) Except for periods when the applicant had leave a...

From this response, looks like they don't want to grant ILR in cases of uinpaid leave. Moreover, when employers refuse to provide letters of absences, they want to have their contact information to verify this is indeed the case (and what if employers refuse to cooperate in such cases with the appli...

I support all your arguments but I think the reasons I have stated in my previous post, the policy seems fine. They are trying to track out of UK holidays DURING your work-related leaves so that they can add it to the ILR absence period. This seems to be a rather convoluted way to address a rather ...
