Based on this new rule.. had a query...any feedback/thoughts/suggestions will be appreciated...thanks.. As the tier 2 arrangement (all categories) was implemented on 27 Nov 2008. All visas prior to this were Work permits even if they were for intra company transfer there was no such category before....

Tier 2 - ICT (Employee paid abroad for a short period)

Hi, I was not aware of this change in rule and only just came across this. As per this change to tier 2 in Aug/Sep 09 , an employee in tier 2 (ICT) can be paid abroad and not necessarily in the UK? http://www.wragge.com/analysis_5020.asp hence I assume that if there is no break in visa and the emplo...

hmm..you do have a point.. then ideally it should 'not count' only after the new ICT rule comes into force.. A loophole should be plugged, but cancelling out eveyones time overnight doesnt sound right..they should be given a chance to switch visas and have the time counted.. if they cant switch to a...

Thats true.. they havent explicitly said that it will count..however, for ILR the rules are that time on WP/tier 2 should count.. but then again.. they could just change that and say tier 2 ICT would no longer count..which will be very unfair though.. but lets hope thats not the case.. The new rule ...

Yea, I agree.. although I think that its better to switch to tier 1 before the rules comes into force 'early next year' to be on the safe side (the ukba site doesnt say the month next year).. I also think that if the change to Tier 1 is done after the new ICT rule comes in , the time spent on ICT sh...

joh118,.. do you mean to say that if blue78 was to change to tier 1 now, the time since 2006 spent on the intra company transfer visa would be counted towards ILR in 2011.? It think it should and you may be right. The rules come into effect 'early next year' it says .. so would the change to tier 1 ...

thanks..yea..thats what i think too.. however, im not sure of the visa i am in right now as it stated ''work permit'' in 2006 and in 2008 when it was renewed here it just says ''UKBA vulcan 2'' and now if i send it for renewal in 2010, am not sure what it will be tier 2 (G) or tier 2(ICT). The reaso...

I should be ok you think ..to apply for ILR in 2011? my time started in 2006 sept under WP. So it will be WP (from sept 06 to Feb 09 - 3 years, 4 months) + ti...

thanks tvn_ramesh. My query is then on this scenario.. I had a work permit from June 06 to June 08 and then renewed again for 2 years until June 2010. I assume all this time will be under WP? Now when the visa goes for renewal, it will come back with tier 2 visa rather than stating WP. Will my time ...

Ok thanks for the clarification..

I understand they didnt exist in 2008. At the moment in 2009 are they considered the same , work permit = tier 2? i.e in my next renewal in June 2010 will it come back with tier 2 on it

thanks Jon,
this might be a silly question..but is there a difference between tier 2 and work permit, or are these the same? my visa category used to say work permit in 2006, when it was renewed in 2008 it said UKBA vulcan 2, so i dont understand what this means..?

Type of visa : UKBA vulcan 2

Hi, Does anyone know what UKBA 'vulcan 2' stands for in the type of visa section of the UK visa. I came here in 2006 and had 'work permit' in the visa section on the passport, but after the renewal in 2008, the new visa says UKBA vulcan 2. I assume this is still a work permit and not any other categ...

Ok, so did they ask you to stay for a further 127-90 = 37 days and then apply? So i take it that you were out for 73 more days and hence your query is whether you need to stay 73+37=110 days before applying, right? I have been out for 104 continuous days and was wondering if I will be asked to stay ...

Were you paid in the UK or abroad during the 127 days you were away?
If abroad, Did the HO mention anything that you need to be concerned about?

Re: ILR - Query on Absence from UK over 5 year period

Thanks pkumar.. I understand that immigration might be aware of such situations and that there are many with the similar cases (with minor differences). Was wondering if anyone has actually applied with such a background, I have described and have qualified? as I have been reading a few posts in the...

ILR - Query on Absence from UK over 5 year period

Hi, I had a query on the qualifying period for the ILR - number of days you can be away from the UK. I understand that there are certain number of days within the last 5 years that the applicant can be abroad on work or leisure. 225 for a WP/Tier 1? My query is as based on the scenario below, I have...
