SET (O) for 10year long residence rule

Hi all those who are waiting for ILR under the 10 year rule. The tracking list has not been done for a while so I have decided to update it. One more thing... never contact UKBA and ask an update on your application; it makes your case worst and they keep you waiting longer as a result of this. I am getting confused with some contradicting information on this.

The question is: Can somebody who is on a work permit and from a non-EEU country apply for Job Seekers Allowance (contribution based)?

If so what is the procedure?

If not, what is the legal basis why they cannot apply

I have just found a decision from Immigration tribunal web site. http://www.ait.gov.uk/Public/Unreported/IA118452009.doc this lady applied for ILR on the basis of 10 years rule. She applied: 12 November 2008 Application was refused: 3 April 2009 so it took HO approximately 22 weeks (over 5 months) ...

Thanks for your response Iyanu. That sounds a good idea but what about the fact that my application has been there for about 20 weeks now and looking at their timescales, it may already be with a caseworker.
