Tier 1 from US - Photograph size

I am applying for Tier-1 from US.
I am having hard time finding a place where they would get me 35 mm by 45 mm sized portrait done.

The standard size here for US passport is 2 inch by 2inch.
Someone told me to just use the US passport size photograph.

Is that acceptable?

Ok, so the form has appropriate sections to fill-in for name change. That's great. So an affidavit from a lawyer or Indian embassy here should be easy. Thanks all for your responses. Does anyone have a format or the verbiage for the affidavit that's been used before and accepted? Thanks for your time.
