Re: moving to ireland on eu family member residence card

Have you looked at the FAQs on the INIS website? I think you would find this useful. You will both need private health insurance and be self sufficient (not on social welfare) . Please don't rely wholly on advice from this board! Get legal advice or research properly by reference to the Regulations ...

those figures seem to be for the UK, wouldn't be relevant to Irish Dept Justice processing times.

Re: moving to ireland on eu family member residence card

It's the British citizen that must be working etc., not you. Sufficient resources is not defined. €50K plus may be okay, I really don't know.

Re: moving to ireland on eu family member residence card

You need to make a written application on Form EU1 when you arrive in Ireland. If successful you will be granted a 5 year residence card. The EU family member must be "exercising treaty rights" in Ireland - working, studying or residing with sufficient resources. Link to form: http://www.i...

Re: Zambrano

Overall it seems to take 6 months - one year. I had one recently where there was a delay as the Department was doing a check with the social welfare system. The mother had been claiming One Parent Family and she shouldn't have been.

Yes they will have to give you the Stamp 4 when you submit the documents. If they don't keep reminding them.

As I understand it the UK has a more restrictive interpretation/ policy on Zambrano that Ireland. The Zambrano/ TFEU/ Free Movement rights are separate from family life rights under Article 8, it seems like your case might be more favourably assessed with reference to these family and personal life ...

I would write to the landlord and the Tenancies Board, sending a copy of each the other, if you know what I mean, and explaining the situation. then, send copies of these letters to the EUTR Section, INIS. You will probably get a letter in reply from the PRTB, send this also to the EUTRSec. They can...

Yes the Dept Social Protection and the SW Appeals Office often make appalling decisions without properly assessing the facts of the case. Judicial Reviews are settled very quickly

Hmmm I am still sceptical as to this, unless you can point to some evidence of the Dept's policy regarding these payments. I don't see how a means testes QA payment attached to a JS Benefit payment is any different to a JSA payment... Anyway it seems that since Shatter, no one is refused on grounds ...

I have to say your experiences don't accord with my own experiences of Dept Justice Policy - particularly in respect of the type of injury/ disability, this doesn't make sense to me. Having an Irish child has not seemed to protect applicants previously refused on character or other grounds (and nor ...

Bredidfromireland, can I just ask where you are getting this information from, eg that a person receiving a Qualified Adult payment is viewed more favourably by the Dept for naturalisation than if he was drawing JSA and claiming a QA for his partner? This doesn't seem to make any sense to me.

OK well if I was you I would re-apply for the CB AND apply for the One Parent Family Payment, and send the HRC form - for immigration status you can state that your application is still pending, you are still waiting. This will get the ball rolling till you get your Stamp 4. Regarding the Zambrano a...

Are you sure you sent them all documents? Send them some more proof of address for you and the babies on Monday. Maybe a letter from your GP, letter from the Child Benefit (I assume you're getting that?) immunisation card, babies' PPSN letter etc. It sounds weird, but you need to submit proof that t...

When the Green Card scheme was introduced, it was envisaged that the Immigration and Residence Bill would be enacted shortly afterwards. The Bill made provision for Long Term Residence (5 years I think?) for Green Card holders after (I think) 2 years. The Bill was never enacted and later scrapped an...

Brigid, I don't think the AP is with the father of her youngest kids any more. Yes, "iwonderwhy" you should apply for a payment. It may not be accepted, but it is worth pursuing. When did you submit your Zambrano application? Processing is currently taking 3-6 months, but can be up to 12 m...
