Thanks IT graduate. I had a look at the sticky thread. It states - that the trip was needed for business reasons. Going on business trip first time - impact to ILR

Hi, I am due to apply my ILR in Jan 2013. So far everything looks good for my case, however I am now required to travel outside UK on a business trip for 10-12 weeks. As of now my total days out of UK in last 4.5 years have been 125 with none of them being business related and none exceeding 90 days...

You will be ok and that is not a problem.

I have applied for an extension in similar way and did not have any issues...as long as they fall in the 12 month period you are ok.

which means I can show payslips from 10 Nov 2011 - 9 Oct 2012.

And I believe the 28 day rule applies to PEO also and irrespective of whether you have leaves remaining or not? THis is because the website says 28 days or 5 years whichever is earlier.

Thanks. Its valid till Mar because I was on WP before being on T1G. So if I can apply on 9th Jan, then does that mean I can show payslips from 9th Oct 2012 - 9th Nov 2012? Can I not show 9th Sep 2012 - 9th Oct 2012 -- As 9th Oct to 9th Jan is 3 months and they say it should be 12 months in 15 month ...

ILR - same points as last Tier 1 ?

I am referring to the first poster in below thread who went to PEO and the caseworker said that the points claimed for ILR should be same as last Tier 1 application. http://www.immigrationboards.com/viewtopic.php?t=98848 I would have thought there is no such rule. Can someone really confirm the rule...

Can someone really confirm the rule regarding the same amount of points?


If I have to claim the same amount of points I will have to wait 12 months and show that many payslips.

If I dont have to claim exact same points as last time then I can apply much earlier.

Correction, the period neednt be consecutive.

It can be any 12 months in a given 15 month period, if you claim for more than 12 months then only the latest 12 is counted.

Exactly...what you are saying applies if anyone shows more than 12 consecutive months. ilr_hsmp2007 is incorrect. Its ok if you submit all the 11 payslips and one of them for Apr is missing. Can someone please confirm if it is true that one needs to be in employment at the time of applying for ILR.

The last time I did my extension I did not have a job but had sufficient points and income, had no issues in getting the extension.
