Re: Help with ILR Application for old WP holder

krishnais, you mentioned that you had changed your job/company in 2007. Hope you did obtain a new WP then (as working on "old WP" for another company is illegal). In such a case I'd advise you to bring both WPs with you as well. Also, although the proof of cohabitation for 2 yeas is not re...

There is no such a restriction for the dependants.
However, you will need to provide proof of cohabitation in the UK covering the last two years.

Re: Skilled migrants to lose right to settle in UK

Theresa May plans to force skilled migrant workers to leave the UK after five years if they earn less than £35,000 a year. They believe the £35,000-a-year earnings threshold will ensure only the "brightest and the best" migrants settle in the UK. "Ministers accept that our economy ne...

I just wanted to bring this thing to light for the WP holders only who are applying for their ILR this year which clearly means that they have got their WP issued back in 2007. I was just going through one of the post "Watch out Old Work permit holders" the rule for SOC came in to being a...

It means no such thing! I really do think you are misreading the situation totally! I wish I am misreading it... To me 185G merely means that there is no exemption for spent applications when submitting the application. But that is not to say that the conviction is not spent! It is! The Rehabilitat...

John, many thanks for your views and clarifications on the matter. Indeed, amendment 185F sounds very promising. However, my primary concern is about amendment 185G and the way it will be implemented in practice (if it will become a law). Taking literally, the currently adopted UKBA policy of "...

Amendment 185G - Convictions shall never become spent

In Government Amendment 185G , the government is going to shorten the term, when convictions become spent, and also to introduce a new law, when convictions shall never become spent for immigration . Namely, they have suggested to: Insert the following new Clause — No rehabilitation for certain immi...

Should the start date of my temporary position (11 Sep 2006) also be indicated in the employer letter as well? Ask yourself, do you really need this date for your ILR application? The answer is NO. As you'll be applying on the basis of 5 years Work Permit, then just indicate what is relevant - this...

But still similar question here, which date should be provided as the start date on the employer letter? This date should match the one on your original WP. - Your employment in the current capacity (supported by WP) has started on 20 Jan 2007 - so this date should be indicated as your starting dat...

Those who are currently on Tier 1 should be NOT affected: According to the second (BBC) link, it says that "It [proposal] would apply to skilled workers, those covered under "Tier 2" of the government's points-based immigration system" Also, I remind you that this consultation wa...

Re: Would over 18 yrs child need to apply on SET(F) or FLR?

The best advice for an over 18 dependent child is to apply together with his parents, but on a separate SET(O) form. (Meaning the child needs to pay a full application fee.) Regarding "As for spouse I am sure its FLR first and then SET(M)" I am not sure what you mean by this... If a marrie...

Actually, I think that your chances for ILR are not low at all, due to compassionate grounds, though your case is not so straightforward... If you can justify or at least provide to HO some strong arguments of why you needed to leave the UK on your annual/maternity leave, this would definitely help....

Re: ilr

There is no exit checks on the UK border at the moment, so only arrivals to the UK are recorded. Still I would advise you not to "trick" and put your actual travel dates, as these 2 extra days is really not a big deal -- caseworkers are quite flexible with such a minor excess (provided tha...

Re: Getting conflicting advice, I have 165 days absence. HEL

I am afraid, your 5 years clock has been reset on 01-Jun-2008, as you had more than 90 days in a single absence abroad. This leads to your continuous residency in the UK being broken, see the guidance on ILR - calculating continuous period in the UK : "...No single absence abroad must be for mo...
