The new SET(M) (and potentially others) forms from 13/12/12 ask about debts and so forth but they are only concerned with CCJs and bad debt.

ILR obtained (Dec 2012) when unemployed and claiming benefit

I thought I'd return after being successful in obtaining ILR despite being unemployed and try to clear up some of the questions and worries I had when my wife applied for ILR last week. Do check you have the correct form. We found out the form changed the day after we filled it in and if we hadn't c...

Can wife obtain ILR when neither of us are currently working

My wife has a settlement visa based upon marriage and should now be applying for ILR as she has been here 2 years. However, I have been out of work for nearly a year and claiming JSA, Housing Benefit, Council Tax Benefit and Child Tax Credits. My wife does not work. We have one child, a UK national ...

Wife in UK on settlement visa but can we get Cat D Shengen ?

We live and work in the UK but want to travel at a moments notice to Europe, largely Spain, Italy and France, but don't want to apply for individual visas. I have my own business and could easily operate part of that from Spain. I also lived in Spain some years ago. Can't we just get my wife a 3 or ...

Hmmm ...... I think I need to say ... best of luck ... you might need it. But I don't think "spite" comes into it. It is simply that the ECO might conclude there is insufficient "reason to return". That seems to be what people think and yet the law requires them to make decision...

I agree with the simple process of obtaining the requisite paperwork but I do not necessarily agree that the ECO is liable to void a visitor visa application. For instance, many of the criteria are the same and none were used as reasons to deny the settlement visa. In fact, the only reason which cou...

Yes marriage is possible. Hardly ideal timing but actually just a bringing forward of an already planned event. Hardly the romantic vision she had planned for herself though, a rushed job in Bangkok. However, if needs must etc. I am not sure a visitor visa can legally be refused on the grounds that ...

UK settlement visa refused in Bangkok - what now ?

My partner was refused a settlement visa as an unmarried partner under Paragraph 295a (i) (a) of HC395 citing that they were not satisfied we were in a relationship akin to marriage or civil partnership which has subsisted for two years or more. The reality is that we are in a relationship for more ...

There are various arguments to support your case which I went through, though fortunately I did not have to rely on them. Timeline - life assurance is paid out if a suicide occurs more than 12 months after taking out the policy. Not only this but other contracts and so forth rarely look past 12 mont...

The reasons for refusal would determine how you respond. If they refused you incorrectly, then you may write to them, asking for reconsideration, pointing out their error. Is this method of writing for reconsideration illustrated anywhere ? I would certainly like to think it was and to see an outli...

UK settlement visa refusal in Bangkok - what options ?

OK, we're still waiting but if we were refused, then what options are open to us ? I understand there is a long drawn out appeal process which would take place in the UK and I understand that one could simply make another application and resubmit, covering the reasons for the refusal. However, I see...

I am in no doubt that were the income side of this application not an issue, it would take 5 minutes to process and agree the visa. You are right though that even in the current circumstances, I would want the decision to be as easy to make as possible and also in my favour. I do take your well thou...

Where the sponsor is already in the UK the ECO will not just look at the amount of income compared to the minimum acceptable level for income adequacy, they will look at your current outgoings based on what you state in the application and your bank statements. Your current standard outgoings (eg r...

John,

Do you think my logic, of covering the mismatch in public funds fully satisfies the minimum adequacy requirements and if so, for how long do you think one must cover that amount ?

I suggest a year at most.

I was just rounding it up. I know the visa is THB 33,488 (around £731) and the TB is THB 2600 (around £57) but as we've a child who she cannot reasonably leave for a couple of days, the easiest way is for her to go stay with her friend for a week and drive over to Bangkok twice for the TB check an...

Yes, she can get ILR a week later if she passes KOL. It is an utter rip off that it cannot be taken outside the UK. Are you sure that her English is up to it, to successfully study for the test and to pass it? No doubt she might do that eventually but in reality only after a period of time in the U...

The argument that one can produce a budget and live within it was debunked by the ruling which established the income support level as the minimum acceptable level for income adequacy. It was accepted that people could live on less than that figure but it was also held that people cannot be forced t...

Hi, I wonder if someone could cast an eye over this logic for a UK non married partner settlement visa. The facts: I am a UK born resident, my partner is a Thai female, we have been in a relationship outside the UK for 5 years, we have a small child who does not need a visa due to having a UK passpo...
