Thank you both - really glad to have double checked with you! As advised, will probably create a separate thread on my questions.

Re: Spouse Settlement to Citizenship efficiently

How soon after being granted the Initial 2.5year entry clearence, may one apply for FLR(M), further more, how soon after may one apply for ILR, and how soon after that for british citizenship? As the person you appear to be asking about only recently entered the UK on a spouse visa, they would appl...

Re: Non-EEA PR holder marrying a non-EEA visitor in the UK

The only risk would be if the Registrar believed the marriage to be sham, but as they are both legally in the UK this would be unlikely. Even those here illegally are able to marry without prior permission from the Home Office. They should contact a designated Registry Office to arrange a date for ...

exact same evidence I used for the EEA4 application. Does this mean just for myself or provide proof for my ex wife too? Exact same evidence for both of you. Your wife's evidence for the first 4 years (until the divorce) and yours since then until you complete 5 years. Just wait two months until Se...

Naturalisation/BC evidences query

Hello, I am wondering if someone could tell me whether I can use the following evidences in support for the naturalisation application: 1) HO letter acknowledging my PR application made on 2 Oct 2012 2) PR issued on 14 Jan 2014, ie 14 months after the initial application was made... I think that it ...

Can Non-EEA National with PR bring a non-EEA national spouse

Hello everyone, Questions: 1) I want to determine whether a non-EEA national with Permanent Residence card is able to bring another non-EEA national family member to the UK (ie spouse). Background: 1) I am a non-EEA national 2) I have obtained my rights to reside permanently in the UK on the basis o...

It seems like an interesting and relevant case - it would be great to find out the result of the hearings. I am not sure if I can rely on the fact that I have retained the rights of residence, because the UKBA issued quite confusing statements. The case is Alarape . It would be more straightforward...

When you came to the UK in 2006, you say you had a "visitor visa", but in your first post you said you came as the family member of an EEA national. Really sorry for the confusion, it might sound a bit perplexing but I applied for visitors visa to make sure that I am admitted to the UK on...

The earliest you could have achieved PR would have been 17/10/11 (ie five years after entry to the UK). On entry to the UK, you were the family member of your step-mother and so lived in accordance with the regulations until at least 23/10/10 divorce when the divorce was finalised. From then you we...

There are a couple of problems here: 1. The EEA4 form does not clearly cover the requirements for a former step-child with a retained right of residence, and 2. The UKBA has issued confusing statements about kroketa's retained right of residence, so we don't know whether they are in full possession...

Re: Need advice on a bit complicated EEA4 application

1) Does the UKBA caseworker refer to my non-EEA national father or the EEA national ex-wife in the citations from the letters in points 11 and 12 of the above timeline? It seems that they refer to your father. He is not an EEA national, but he is treated as one for immigration purposes, and he is t...

URGENT: An expiring passport in support of EEA4 application

Dear all, I am about to submit an EEA4 form for the PR on the basis of (more than) 5 years of continuous residence in the UK as a family member of an EEA national, who at the end of the time retained the rights of residence following the dissolution of a marriage. As part of supporting evidences for...

As a child or stepchild of someone who was a migrant worker, before the migrant worker left the UK, or the relationship ended in a divorce, he has a standalone right, by virtue of Regulation 1612/68 Article 12 to remain in the UK until his studies are completed. This part of 1612/68 was not reppeal...

I don't think his right of residence is only dependant on that of his father, or his father's ability to qualify for a right of retention of residence. child retaining right of residence after parents divorce

Hi everyone, this is my first post in this forum and I hope to do it well and as clear as possible. It have been very interesting to read people's truly epic experiences of battling for their retaintion-of-the-residence right after the divorce. Every such a case that I have read so far has been abou...
