Re: EEA3 refused - problem with unemployment

Being unemployed you have to be registered with JSA otherwise your status would be as Self-sufficient - and in this case you need Comprehensive Health Insurance and prove of your funds. To get help from Europa, you need to explain them the situation and if you are eligible to get PR by law they will...

Re: Naturalisation via EEA PR route (passport doesn't cover

Thanks for the reply. But if I supplied all 5 years p60's proving PR status before, what the point to send them again?
Ok, I do not have passport covering all years, but PR already proved these years. Even having EEA pasport covering all years it doesn't proving those years either.

Naturalisation via EEA PR route (passport doesn't cover 5 ye

Hi, can someone please advice, for EEA national with PR (Permanent Residence) status for more than 1 year, how to prove 5 years lawful residency in UK if passport does not cover all 5 years?
Is PR enough to prove residency plus last 1 year of passport, or payslips?
Thanks.

Re: British Citizenship - EEA nationals exercising EC Treaty

You do not need to fill those sections once you have PR. Once PR obtained you are not EEA national in UK anymore - you are settled.

that means other EEA decisions must pay fee!

EEA3 refused - problem with unemployment

Dear forum! On 23 of February 2012 I have received refusal (second time) of EEA3 application for Permanent Residence in United Kingdom (please see refusal letter below). The main reason is that I get Job seeker allowance benefits in UK for more than 6 months.. - as I know person is continuing to be ...

This Compliance studies states that i , ii and iii are disjunctive, which is what i believe it should be. In several cases i have seen, the UKBA have argued it is cumulative as opposed to alternative or disjunctive. The directive and the case law indicates they are two different categories of benef...

You may be excused for thinking the semi colon between i and ii indicates they are mutually exclusive, however that is not the case, and the courts have not been interpreting it that way so far. The fact that there is an (or) between ii and iii, indicates that it is the interpretation of the UKBA, ...

Yes you are correct, i meant involuntarily unemployed. According to the EEA regulation 2006, being involuntarily employed, is not the end of the matter. You will only be able to retain your worker status for 6 months, and after that period, you have to show that you have a good chance of seeking em...

You have few hurdles to overcome. 1. Yes you are right, the fact that you were employed for a year or more means you can retain your status as worker, provided - You were involuntarily employed - You are registered with the Job centre. Were you voluntarily or involuntarily employed? 2. The EEA regu...

It cannot possibly affect your move to PR, given that is determined by the terms of the EU Directive, and there is nothing in that Directive about whether a Worker, as defined, can claim benefits or not. Of course you get PR status automatically, without application, after exercising EU Treaty Righ...

Insist upon making the benefit claim you seek to make.
So, that mean if I receive JSA and HB/CTB it will not affect my EEA3 application?
