considering they only announced that Tier 1 INITIAL applications were closing 48 hours before they actually did close them back in December. from what i have seen, it appears if you go over 5-6 months you get stamped from date of application, less than 5 months it appears you will get from date of expiry of visa.

The 3-5 month area is somewhat grey and I suppose at the caseworkers discretion.

well i suppose it depends on how bad you want the Tier 1 visa, if I was in your situation I would explain to my boss that I am taking unpaid leave to write the english test and use my degree rather than go down the appeal process.

but its your choice....

if you got your visa in October you already past the 28 days and so would need a 2nd extension in any case.

its fairly critical to enter the UK shortly after getting your visa, unless you dont mind going through the whole extension thing again and paying the extra cash.

you can apply anytime, but you will get visa from the date your visa is processed not the expiry date of the visa
