Re: EEA Family Permit to join my husband

Are you in fact an overstayer? If your first husband remained in the UK as a qualified person (e.g. a worker until you left the UK, which was before the decree absolute finalised the divorce, then by the Diatta judgement you were lawfully resident in the UK as a family member of your first husband!...

Re: EEA Family Permit to join my husband

Do you think I can be refused as overstayer? I will die if this happens, and my husband will be devastated too :( What can you advise? Are you in fact an overstayer? If your first husband remained in the UK as a qualified person (e.g. a worker until you left the UK, which was before the decree abso...

Re: EEA Family Permit to join my husband

Will the circumstances of my first marriage affect my new application in a negative way? Will I be considered as having previously overstayed and refused my application on this basis? Since our bitter separation in early 2014 me and my first husband had been completely out of contact and I am not su...

EEA Family Permit to join my husband

I am planning to apply for EEA FP soon to join my EU husband who is self employed in UK. This is my second marriage and for my husband it is his first marriage. I am currently outside of EU. I hope to get some advice here as I am really stressed about my application and feel huge responsibility to g...

EEA1 and EEA2 maintenance funds requirements?

Hello everybody, Me and my EEA husband will apply for EEA2 and EEA1 respectively in a few months, but one thing is really bothering us: Are there any financial requirements for him (or us?) Is there any minimum amount than he must have each month on his bank account? (like for Tier applications?) If...

That's an exceptionally excessive list. Under EEA regulations you would only need a small number of those mentioned. Lumping requirements for settlement and EEA regulations together is particular idiotic. And the EEA route doesn't know about 'sponsors'... The last document from UKVisas, the most tr...

If you have found such information on the web it would be useful to link to it. This information here does not mentions any set period. I would obviously also depend on how long the EEA national has already been in the UK. (Interestingly, this link appears to indicate that all mentioned documents w...

There is actually a bit of confusion about his time in UK. He was there since March 2009, but wasn't working. He then already got an NI number and opened a bank account. In spring 2010 he spent almost 2 months in my country and we got married. When I was applying for FP in July, I was recommended to...

bank statements

For how many months they do they want bank statements exactly? On UKBA website there is a number 3 months... On some guidance i found on the web for settlement and Family Permits it says 6 months... We managed to get statements only for the last 4 months. In the bank they say to get for 6 months we ...

Your dates don't make much sense. Before May 2011 you can only apply for a residence card if you meet the criteria under the WRS. After that date you are free to apply for a RC provided that the conditions under the EEA regulations are met. That's what I am saying - if my FP will expire shortly bef...

Family permit and WRS

Hi all :) I am just wondering... I am about to apply for an EEA FP in couple of weeks. My EEA husband has recently send an application to register with WRS, so if they get him registered, the 12 months period for us would end somewhere in September 2011. However, the WRS will be stopped after 30.04....

I think it said somewhere in the guidance, that the copy must be certified... In UK it costs 5 pounds at post office.

Basically, you could tell UKBA something like: "Directive 2004/38/EC is clear that there are NO preconditions on residence for the first 90 days in the UK, for either the EU citizen or their non-EU family. Work is not relevant to a decision when the EU citizen has been in the UK for under 90 d...

I personally would not wait for anything. You have a couple of options that I see: (1) You can immediately appeal the current decision. (2) You can submit a new application along with a strongly worded letter that points out that your husband has only been in the UK since May and that he has an UNC...

Can your husband get a letter from his employer stating that he is working and how much and how much he is getting paid? You could then resubmit the application for the family permit and see what the embassy says. In fact, I submitted the original work contract AND a letter from his employer(he is ...

Why did you not travel together to the UK? After the first 3 months, he either needs to be working or actively looking for work. Either is fine. I read on Home Office website that even if we will travel together I need to apply for EEA FP and at that time we didn't have the documents ready to apply...

Re: Appeal to the Entry Clearance Manager

Have your husband write them a letter that during the first 3 months he doesn't have to be a qualified person ( it is called initial right of residence) and you have the right to accompany him. In his letter he didn't mention this, because he IS a quialified person, as he is working as self employe...

EEA Family Permit refusal

Hello there, I've been recently refused an EEA FP to join my Polish husband in UK. The decision: You have failed to provide evidence that your EEA national family member is a qualified person in accordance with Regulaiton 6 of the Immigration (European Economic Area) Regulations 2006. I am, therefor...
