Thank you CR001, What would you suggest she do? They still live together but no longer in a relationship. Can she apply using a different address as a parent of a british child? The kids are 2 and 6 years olds.

Can she use the same day premium service to apply?

In the meantime she needs to do as well Life in the UK test and English tests which are needed to apply as a parent of a british citizen

Thank you for the reply. Form FLR fp is saying the applicant must be in the UK and before current visa expires. She does not hold any visa at all besides her asylum UKBA Issued card

They live together under one roof but it seems husband is no longer interested in the marriage. He is only keeping her so that she look after the kids. Is there any route she can take using her kids? Any immigration sections she can take advantage of

I have attended both Solihull and Sheffield. I have found out that Sheffield is much friendlier. With chances of being interviewed very very slim. And the process is quick as well as they are not as busy as Birmingham

This is a relief. We have an appointment on 12 June at sheffield.

The other thing is She has recently changed surname from hers to Mine. Does this matter much in the eyes of UKBA? as long she can prove that she is still the same person?

So can we include this expired proof of ESOL in the application with a note stating that this has been submitted already in the previous application?

Another question is in the event that she is successful in getting ILR can we apply for naturalization soon after without waiting for 12 months?

Firstly, just to emphasise it, for Naturalisation applications there is no 28 day leeway. But actually that does not apply to you as you are married to a British Citizen.
