Re: PEO applications worth it?

I always go for PEO for safety. I will know immediately if there is any issue with the application and will have more time to correct it.

Re: Lead time for premium service

Are you sure you CAN and WANT to switch from T2G to T2ICT? Even if it is possible (which I doubt), you'll lose ILR elegibility. The lead time varies a lot. I looked earlier this week for slots on 14th of May at Croydon and many were available. If money is not a problem you can usually get one next o...

1 are 2 answered in UKBA official Tier 2 guidance, make sure to check both sponsor and migrant versions. 3 - yes, you will be issued a BRP. It takes from a few days to a few weeks to arrive, but I believe you can start working before that if the CoS allows.

Changing sponsors: must I resign first?

What happens if I apply for < Tier 2 General with a new sponsor via same-day service, but I am still working for the old sponsor?
I want to resign immediately once my new application is approved, but not before. Is that possible?

I'm on a Tier 2 G already, so it will be an unrestricted CoS.

Re: Can I register consultancy company during Tier 2 General

You cannot do it yourself. But you should be able to contract via an umbrella company if they hire you as permanent part-time employee and you work outside of your main working hours. See "Supplementary Employment" in Tier 2 guidance. Regarding your wife I'm not sure, but I knew a Tier 4 d...

Re: Does change of passport affect Tier 2 extension?

In my experience UKBA doesn't care much about passports. They rely on the information about you that they themselves collected. In your case I would get the extension with the Ukrainian passport, if that is possible. You will have your new visa separately on a plastic card, and should be able to use...

I'm no lawyer, but I think that payroll is the employer's responsibility, not yours, and hence shouldn't affect your rights. If your employment has not been legally terminated, I wouldn't worry about it too much.

I've spoken to a solicitor about a similar situation and they said NOT to wait for the letter and consider your leave to be curtailed 60 days from when your employer notifies UKBA. In my case, the letter never came.

Re: Lost job on tier 2 (general) visa

Regarding advertising the job before they can sponsor you, you are right. But often they will already have run a suitable job ad for long enough, so it can be used immediately. It makes good sense for you to book a PEO appointment for a new Tier 2 in advance, so you can start on the new job quickly....

Not using change of circumstances form

I just recently learned about UKBA change of circumstances form (online or postal) and I'm worried because I never used it. I've been on Tier 2 General for 4 years and moved house several times. I always did just two things: notify my employer and get it recorded on my registration certificate. I wa...

Re: Is it legal or illegal to stay on bench period on tier 2

Even if you keep being paid you may not stay "on bench" as long as you want. One consultancy I know of generally allows 3 months maximum, although they would be happy to pay you for longer. They say this is a UKBA requirement.

sumlak, you may want to look into Tier 1 Enterperner visa. Be aware though that switching from Tier 2 will reset your ILR clock :(
FaaLee, Tier 2 sponsors can be consultancies. For work that is project-based and not routine, it should be reasonably easy to comply with UKBA policies.

One sponsor I know is against this and instead uses three-party agreements signed by both the client and the agency. The Tier 2 guidance explicitly disallows "agency workers", whatever that means.

Re: Under Tier-2 general visa can I work for any company or

You can do contract work for other companies as long as it meets the criteria for "delivery of services" set by the Home Office. The official Tier 2 sponsor guidance sets these in broad theoretical terms (do Google the PDF.) What this would mean to you should be explained by your sponsor. ...

Re: How long would you have if resign from current sponsored

At least 60 days from the time your sponsor notifies UKBA. If you do have to leave first then look for a new job, it's a good idea to book a PEO appointment for your next Tier 2 as late as possible in time, but within the above timeframe. Being able to sort your visa quickly and start on the job can...

The document you want is Tier 2 policy guidance for sponsors, searchable on UKBA website. I don't know much about SOC situations, but having read the above document I share your concerns. Best to consult a solicitor as a mistake may turn out very costly to you and your employer.
