Re: Foreign income (freelance) on Tier 2 visa

I would certainly not declare any income on a Tier 2 other than the salary (which is handled by your employer anyway).

Re: Switching Jobs on Tier-2

It is certainly legal. But starting on the job B may take you longer than expected because I don't think you can have multiple live COS for the same person in the system. I can easily imagine it becoming a long and painful process if the company A does not cooperate. OTOH, if you do get your Tier 2 ...

Re: Seeking for Sponsorship

There are job boards that let you filter by sponsorship - for example, the JobServe.com board. In principle it is possible to get sponsored by a consultancy that will sell your work to other businesses. But it has become much more difficult in the recent years due to stricter Tier 2 regulations arou...

I had my leave curtailed in the past and never ever got the letter. There are other people here who had the same experience.

Re: Self-employed while on Tier 2

There are at least two things to consider: whether you must disclose to HO that this work ever took place, and what exactly has been fixed on paper (HMRC forms, etc.) It's been a while since I applied for ILR, but I do not remember having to list anything but permanent employment. You should downloa...

Re: Going away for 6 months after application: UK address?

Noetic, the solicitor who represents me is the point of contact with HO regarding biometrics, etc. noajthan, not sure what you mean by BNA 1981 not making allowances. The BNA makes the situation easier not harder because it only considers absences BEFORE the application. Once you've applied, you're ...

Re: Going away for 6 months after application: UK address?

The period in which absences are considered ends on the date of application. See Section 6 of British Nationality Act 1981, it's very clearly stated.

As I explained, I want to travel to avoid huge non-resident property sales tax. It requires physical presence.

Re: Going away for 6 months after application: UK address?

This is possible in theory. But then I would have 183 days of recent absences declared on the applcation. This seems more of an issue because the guidance clearly says that this is how they assess future intentions. Also, putting it away increases risk of unforeseen circumstances interferring.

Re: Going away for 6 months after application: UK address?

True, but I certainly wouldn't risk it if I didn't check with the solicitor. I've known them for years, they have a lot of experience and good reputation. I couldn't find any reports of applications refused on this or similar basis. I will update on how it goes.

Re: Going away for 6 months after application: UK address?

I was worried about this too, though the reason I need to be away is selling my property in the country of origin to buy a home here. If I'm not physically there for 183 days in this year I will be taxed 30% of sale value (normally 0%). Such is the law. The only alternative is to get citizenship the...

Spoken to my solicitor about this and he said that mail forwarding address would do. As for biometrics, coming to UK to do them is no problem.

Re: Going away for 6 months after application: UK address?

My solicitor said that they'll witness copies of my documents so I can keep the originals and travel. But if HO still asks for the original passport then yes, I'm prepared to return to UK and remain here until I get it back. Going to home country is important but the application is more so.

Re: Going away for 6 months after application: UK address?

I can visit UK on short notice when needed. It's just that I need to spend most of this year in the home country to sort things out there. There are various redirection mail services, but given the importance and cost of the application I need to be sure it's OK to use them. Otherwise I would rather...

Going away for 6 months after application: UK address?

I want to apply for naturalisation (not married to BC) and go to my home country for about six months to finish my affairs there. Immigration solicitor said it's OK to do that (at least with their representation), but a UK address for myself is necessary. I am not a home owner and renting for six mo...

Re: Tier 2 sponsorship curtailment & Tier2 to Tier2 applicat

I never received the HO letter when my employment was terminated in 2010. I then spoke to an immigration lawyer about it and they advised to act as if I had received it. I eventually got another sponsor, but the letter never ever came.

Passport lost - is it possible to apply for ILR?

A friend of mine lost his current passport while preparing to apply for ILR. Getting a replacement is going to take a while. He still has his previous passport with the entry clearance. Is it still possible to apply? The Set(O) form seems to allow to explain why required documents such as passport w...

Re: Absence letter from previous employer

If memory serves, HO guidance mentions such a case and suggest you should explain the circumstances and why you cannot provide the letter. If I were you I would make a written request to the company, post it with registered mail and include proof of posting in the ILR document package.

Re: Cab office Tier 2 sponsorship acceptable?

There do not seem to be any restrictions on the nature of business when it comes to Tier 2. It is the role that matters. They may decide that they need an IT engineer or developer to grow their business or branch out into new areas. And as long as they are able to explain their needs, it is not for ...

You need unrestricted CoS. They should not have applied for restricted. Now they should contact HO and explain the situation.

Re: Long Term Stay options in the UK from Tier 2 ICT Visa

You may want to start looking for a new sponsor offering you a proper Tier 2 General. For someone with your salary they shouldn't be too hard to find. You may have to take a pay cut, but you will make up for it once your ILR is secured. Speaking to your current employer about this issue is not a goo...
