Re: ILR date

Thank you. No, she is not married to a British citizen (she received her ILR via Ancestry visa), so will have to wait 12 months. Not in any rush - I just wanted to be sure. Thanks :)

ILR date

Just a quick question please... Is the time spent waiting for ILR approval considered to be "free from immigration control"? I'm assuming not. For e.g. we applied for ILR in October last year. It has now been approved after 5 months, so the BRP is dated March. I assume that we will now nee...

Re: Qualifying period

Thank you very much. I assume once submitted - as long as submitted before expiry, it doesn't matter how long it takes to get the biometrics appointment (even if it falls after the visa expires), as she would be covered under section 3C of the immigration act?

Re: Work requirement for Ancestry visa

Thanks. We have read all the guidance in detail. However, it is not clear whether being paid to care for a grandchild counts as employment. I.e. if filling in Set form O, would this be classed as "working in the UK" or as "a relative regularly giving you money"? Thanks

Work requirement for Ancestry visa

Hi All, Just a quick question please... A family member is in the UK on an Ancestry visa. Working, or looking for work, is obviously a requirement of this visa, but the guidance says this can be part-time or voluntary. As such, would caring for another family member's child be considered as employme...

Update visa application papers?

Hi All, Quick question please... So, my friend applied for a fiance visa a few weeks ago. They submitted evidence of their wedding date and venue booking, but it's now getting close to the wedding date and they've not had any news about the visa. So they have decided to move the date of the wedding ...

Unpaid leave and salary calculation

Looking for some advice please... If someone started a new job in December - they were on an hourly rate during their probation month, and earned 1700. They were then made salaried in January and their annual gross salary became £20000 (around £1660 a month). But...in May they will only receive arou...

Re: Voluntarily elected to leave question...

Thank you for the fast reply.

The purpose of her travel to the UK wasn't a holiday though - she was already resident in the UK and returning after a holiday elsewhere?

Re: Voluntarily elected to leave question...

One more question please... Have you ever travelled to the UK in the last 10 years...Please enter details of your 5 most recent visits. If the person had a dependent visa from 2016 to 2018 and travelled to the EU a couple of times for short periods for holidays...I assume they need to list each retu...

Voluntarily elected to leave question...

Please could someone clarify how to answer these questions: 1. Have you ever been deported, removed or otherwise required to leave the UK? 2. Have you ever voluntarily elected to depart the UK? The situation is that the person had a dependent visa. The marriage broke down so they let the home office...

Re: Whose income can count for financial requirement?

No, they don't have children.

We also can't think of any other visas unfortunately. :( It's so frustrating when someone who wants to be here, has worked two jobs for 2 years and paid taxes and generally contributed, cannot stay.

Hopefully things will work out...

Thanks again for the help

Re: Whose income can count for financial requirement?

It's heartbreaking for them both :( She has known him for probably 1.5 years, but they only "officially" started their relationship around April this year when she and her husband decided they couldn't make it work and separated. They started living together then but obviously she is still...

Re: Whose income can count for financial requirement?

Thank you for the fast reply - much appreciated.

And yes it is still about her. She has now received her curtailment letter so just confirming her options before she goes back :(

PS) It is about a friend - I already have British citizenship.

Thank you again for your help!
