you are applying on completion of 5 years, you are now a tier 1 so you apply in that category. For ILR you have to have completed 5 years with most recent leave as tier 1, the remainder can be WP.

Officially she has overstayed if the visa was only valid till 5th August. That said for SET(M) applications there is no requirement for the application to be in time so as long as you have demonstrated that you meet the rules, get the application in ASAP and you should still be granted

if you were out for a period of more than 6 months then its a fail, you should have made the odd trip back to the UK so your 8 month gap wasnt considered as 1 solid period out of the UK. The entry and exit stamps which would be used to confirm this would have supported you.

dont apply for a spouse visa, all the documentation you will require to demonstrate your relationship will show that he was divorced AFTER you married and could invalidate your application. You could go down the fiancee route and marry in country
