you have to inform the HO and you don't qualify for retention. if you want to apply on a 10 year basis you have to legalise your next two years by studying or work permit

everything under EEA regulations is automatic, you don't have any obligation to apply and you are legal regardless of having a residence card, PR, ROR or whatever.
so, you can apply straight for pr without the need for ror

Well, I went to Amsterdam with " my wife at that time" and we used easy jet and there was no problem. Only my passport, UK residence card and marriage certificate and nobody either easy jet, UKBA or Dutch immigration authorities asked for more.

an update, I met with wife and we downloaded the form D8 for divorce. we will send it to Edmonton court, North London. regarding retention, she is not going to provide any documents at all and she will change address during or after divorce as it is getting expensive for her to stay in the same flat...

if you were issued with a residence card before, 100% you don't need his passport. if not, then you need either the original passport or a certified copy.
