Thank you for these very interesting references. They are however both concerned with cases that fall outside the Citizens Directive. I still haven't found any reference to the Rights of the Child in the context of Directive 2004/38/EC, and yet the Commission thought it desirable to raise the point....

If I understand correctly, you can ask for your passports to be returned, and this is supposed to happen within 10 days. But perhaps it won't, and you would have to rush your EEA2 application. I think you should take that application very seriously indeed. Based on my experience there is a real risk...

Do you have any news on the case involving an Article (3) 2 family member? I have an 'other family member' in exactly the same position. She was granted a Family permit by the UK, but refused on renewal. We are going through the appeal process now.
