Re: Zambrano Case and fees..illegal?

I know what you said, but you can't invoke a spirit into the Directive that was not clearly intended. Zambrano says nothing that assists the op in the question that still needs answering. Also, there are now question marks as to whether Zambrano applies in general or whether it applies to only wher...

Re: Zambrano Case and fees..illegal?

You may be right, but you say the spirit of the Directive. You can't impose obligations of the Directive on a Member State, when its clear that the applicant does not comply with that Directive. I mention that its against the spirit of the Directive as Directive 2004/38 is commonly called the Citiz...

Re: Zambrano for Non-EU spouse of EU citizen- Conundrum?

Hello everyone, I posted on here previously about been denied PR on the basis of marraige to a British citizen. I have decided to appeal this decision but to be on the safe side and mitigate my lack of immigration status in the state, I have been adviced by people to apply based on the Zambrano dec...

Re: Zambrano Case and fees..illegal?

Hello Forum, This website was recommended to me by a friend and I will like the opinion of members. I recently got a Stamp 4 as the parent of an Irish child based on the Zambrano law, I was under the impression that since this right was under the auspices of the EU, no fees would be attached. Howev...

Dear all, I have been living in Irelag nd since 2003. I came here aged 15 and on the basis of a joint parent visa. I was first given a GNIB card when I turned 16 and was given a stamp 2. about one month ago.I don't think it's a backlog in the usual sense, but rather a process of the 2 Depts coming to an agreement on the policy (and procedure) on these cases. I believe that the Irish Legislation allows for visa free travel for holders of a residence card issued under Article 10 so that the wording of the card should not matter as there will inevitably be wording differences on the cards. As long as it is issued under Article 10 of the 2004/38 Directive....

On other note, what stamp they will put in the passport? In theory they should not stamp your passport if you have a Residence Card. You should ask them not to stamp it, and refer to the SI which prohibits stamping passports when then holder has a Residence Card. But... The way that Ireland has all...

The Zambrano case was an Article 234 reference so the relevant Court in Belgium obviously were of the opinion that the matter involved an issue of EU Law. Obviously the Court itself and I belive the Advocate General didn't have any issues with jurisdiction of the ECJ. Zambrano is a special case, as ...

Hi guys! Does it mean if I have bad character(road offence, drunken driving whitout insurance,finally-3years out of road and fine 200 euro) If I have the oportunity to be an irish citizen ? You are sorted then, your son born in 2010 is Irish provided you show your Latvian wife living history, her exercising treaty rights (p60/p21/bills/statements etc) as per immigration lawyer suggestion. I am kind of amazed as to why Brophy did not cop on to that. I wonder why ... £$ . I'm amazed at...
