Re: Been in uk since 2006 but has complication extra

You don't list all the dates such as when you switched to Tier 1, when you switched to spouse, and what dates were the year you were out of the country.

Depending on everything you may want to look into the feasibility of SET(DV) which is the ILR application for victims of domestic abuse.

Re: EU citizen in UK since 5 years ago

As an EU citizen exercising treaty rights you automatically attain permanent resident status after 5 years. There's nothing to apply for. However, if you intend on applying for citizenship after being a permanent resident for 12 months, it may make the application easier if you have the proof. You c...

That rule applies to holders of Tier 2 General visas who entered under the rules in place from 6 April 2011.

Re: When can I apply for ILR

It's 5 years (minus 28 days) from when you entered. The grace period back to entry clearance is for people whose visas will expire before the 5 years from actual entry.
As to your daughter, as she was born in the UK, you can register her as a citizen after you successfully receive ILR.

Re: Absence from UK -Please Help

You're overthinking it. Being on vacation in the country is not an absence. You don't need to track your time off within your normal vacation allotment if you don't leave the country. Keeping rack of the dates you are out of the country is your responsibility. Your employer simply needs to corrobora...

Re: ILR qualifying period commencement

Your Tier 2 ICT was well after the April 2010 change so time on it does not count toward settlement. Your clock started 20 June 2011.
It's only an additional 6 months so definitely not worth the risk.

Re: ILR for Tier 2 ICT

Tier 2 ICT visas issued from 6 April, 2010, do not qualify for ILR, hence the April 2015 date (5 years from 5 April, 2010) You don't state the details of the gap of which you speak, so it will be difficult to say. For example if you entered in November 2009 then left and re-entered on a new visa iss...

Re: am i eligible

I don't see how you'd qualify yet. Even if your clock didn't reset, it's too soon under the 10 year rule, as you didn't start until February 2006. But I'm guessing your clock reset during the long absence (10 year path allows absences of no longer than 180 days at a time) and started again when you ...

Re: ILR Fees to increase from 6th April 2015?

ILR fee is going up by about 50% from (standard service) £1,093 to £1,500. The fee for dependents (of non-armed services personnel) is rising £1,982 to £2,141. Priority services are extra. https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/401236/indicative-visa-charges-for-20...

None that I know of. That visa category was specifically changed and the change took effect 8 months before you entered. In an ever tightening immigration system, exceptions become more and more non-existent.

The guidance towards five years https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/275188/ILRcont_periods.pdf specifically says only ICT visas under the pre-10 April 2010 rules count towards the five year qualifying period. So your qualifying period for ILR didn't start 17/12/...

Re: Apply for ILR 2 months before eligibility

The rules are clear that you should not apply before 28 days before you are eligible. If you're current visa expires 2 months before you are eligible to apply for ILR you will need to extend it, the only time being an overstayer is overlooked is if it is within the 28-day allowance. Others may chime in but it appears as if you cannot apply for ILR now nor will you be eligible. You said that between 7 July and 31 October 2010 you were living in India and did not have any visa. This suggests a break in residency since you weren't out of the country on an existing visa in relation...

My reply was more in regards to msx2013's drink driving conviction. Smam, you have an FPN. FPNs are not considered convictions. If you appeal it then are found guilty in court, that will be a conviction. It may be safer to just pay the FPN so that it falls under the: Caseworkers should remember that...

It's not that "spent" and "unspent" convictions are no longer considered, indeed they are. It's that they are no longer using the Rehabilitation of Offenders Act 1974 as a basis. They have their own criteria now, which are outlined in the guidance document http://www.ukba.homeoff...

As you were born after 1 January 1983, it would depend on your parents' status. If neither of them were 'settled' or citizens of the UK then you are not British.
It sounds as if your father was in the UK on a student visa and your mother as his dependent. If so, then the answer is no.
