Is 7 months sufficient or must I get all 12 months?

Thank you for your response. I meant I have official printed statements for 7 Months but wondering if I need previous 5 months. From various posts it appears one needs a minimum of 3 months most recently but not all 12. I am not submitting Internet statements. Is this correct or do you suggest I get...

Bank Statements: 7 months available

applying on wednesday for ILR as a tier 1 general migrant having completed 5 years continuous. I have printed bank statements for (most recent) 7 months. From various posts, it appears between 3 to 6 months are asked for by case officer; in some cases more handed over but most recent taken. This is ...

Is it straightforward enough for the PEO case officer?

It took me 6 months and finally, intervention form my MP to get the UKBA to say in writing that there was no gap in leave to remain on account of this issue. That being said, I wonder if this is now a sufficiently 'straightforward' case for the PEO or will this need to be referred to senior etc for ...

Should I go for PEO route?

I intend to apply for ILR in Feb 2012 through the Solihull PEO which is nearest to my residence. Given the numerous incidents of decisions being deferred, I am writing to seek your opinion of whether I should go through PEO or postal route on the basis that: 1 I complete 5 years continuous stay and ...

Thank you. This suggests that I do not need to add my (uk-born) son to the settlement application we intend to make in February but as soon as that settlement is granted, we can register him for British citizenship via MN1 immediately (whereas we follow in 12 months)? Am I correct? This appears to s...

Dependant born in the uk

I am applying for ILR when eligible in February 2012, along with my family. I understand that my son, who was born in the UK, becomes eligible for a British passport immediately thereafter while we have to wait for 12 months. is this correct? Can this be done during the ILR application or is a furth...

Continuous Stay:

How can I work with my MP to have this looked in to?

Evidently there is a precedent of applicants receiving this kind of regularisation of short gaps in UK stay [due to the Pankina judgements]

UKBA changes its mind!! 'Continuous Stay'

I was advised by my MP's office that the UKBA were going to issue me a 'continuous stay' letter following consideration of the brief stay out of UK when I switched from Tier 1 to Tier 2 following refusal for maintenance funds (Pankina application was successful). However when this letter didn't arri...

Calculating absences from UK for ILR: Spouse on summer hols

I understand that you need to have less than 180 days absence from the UK, paid holidays and business tours are not counted. My wife (who does not work) usually takes 5 weeks holiday outside the UK every year to stay with her aged parents during the summer. This is during the school term break, we m...

Continuous Stay confirmed : MP intervention to UKBA

I wrote several times to the UKBA, and called and faxed and did not receive this confirmation for 4 months. Following advice received here; I wrote to the UKBA via my MP and am advised they are writing to me now with confirmation of continuous stay. This means I can apply for ILR in Feb 2012 saving ...

Re: Still no response from UKBA despite reminders/calls

I will suggest you talk to your MP and ask him to contact Home office for clarification or contact a solicitor. I did speak to my MP who wrote to the UKBA, they responded immediately to say they are writing to me with 'continuous stay' confirmation. This means I can apply for ILR in Feb 2012 saving...

Interpretation

Sent this fwd to him.

His reading is that he is allotted a certain no. of points against specificed earnings, and no harm if it is lower than £39,200 with which he applied the last time so long as it is above £20,000.

Is this sound?

Thank you.

Preparing for ILR 2012 with lower wage

On behalf of a friend who needs some advice: 1. Successfully applied for final Tier 1 extension in 2009 with an annual income of £39,200 2. Becomes eligible for ILR in Feb 2012 (based on current 5-year continuous stay requirement) 3. However has lost his job in Dec 2010 and is currently self-employ...

Do I have any other way by which I can get UKBA to respond to my request?

I have no issue with them declining my continuous stay premise but atleast I know where I stand

Confusing lack of progress

I have not had any response from the UKBA to my letter dated 1-Feb 2011 seeking confirmation of continuous stay. I have sent them another copy today with all the relevant details. I rang the UKBA but they were unable to offer any guidance as this does not fall to one of their timed-decisions (I have...

My original Tier 1 application had been refused for Maintenance Funds only, forcing me to make an overseas application to switch into Tier 2. Following the Pankina judgement, I had a favourable reconsideration and a Tier 1 visa was placed in my passport. I am wondering if my ILR clock is reset or ca...

Regularising immigration status under Tier 1

I would request and much appreciate any guidance you can provide on the following. I have recently received a Tier 1 General Migrant Visa following re-consideration under Pankina Review. I had spent 2 years under HSMP, then applied for Tier 1 which was refused for maintenance funds under the limit f...

If applicants follow the instructions, it is very straightforward. If you are within UK, and meet all qualifying criteria set out in the guidance; send a letter requesting re-consideration along with your passport (and those of dependants originally refused as well) with 2 x passport photographs fo...

Very straight-forward process if you qualify for a review: a simple letter quoting Home Office Ref #, name and address. Evidently takes 2 weeks with or without a consultant. So in my humble opinion, I don't see the benefit - especially as a consultant will charge you! Follow the guidance notes to th...

Following Pankina Application: Continuous Stay After Refusal

My tier-1 leave to remain was refused in January 2009 due to a maintenance funds following below the limit for 3 days. At the time, I appealed but withdrew the appeal after a successful Tier 2 visa application made from overseas (as by this time my leave to remain had expired). I have received a Tie...

For successful Pankina reviews of Tier-1 refusals:
Is the new visa from original date OR from current date of application?

Thank you.

CLARIFICATIONS ON PANKINA REVIEW: tier-1 refusal

Hello: My Tier-1 application (and those of 3 dependants) was refused in Jan 2009 for not meeting the maintenance fund requirement for a few days. We switched thereafter to a Tier-2 work visa (out of country application, following resident labor test being conducted, valid to 2012). I now understand ...
