Re: Ever made a fresh application while appeal is pending?

I am not an immigration law expert and would defer to the expertise on this forum. But on a common sense basis: Do you/your lawyer believe you have a strong case for appeal? In which case why the need to withdraw? If you formally withdraw the appeal, what leave do you have to remain in the UK? If yo...

Re: IS81 and removal on voluntary basis

Thank you for your thoughts. The IO had no grounds and did not find any material (as there wasn't any to find) after two interviews, speaking to the client and searching his bags and person. On removal, My friend was told his visa continues to be valid explicitly when he asked. But he does not inten...

Re: Ever made a fresh application while appeal is pending?

I presume you lodged an appeal to buy time to consider your options, and do not hold much confidence that the appeal itself with generate a positive outcome. If you now have an application ready that you're satisfied will meet your desired outcome, you can withdraw your appeal formally before making...

IS81 and removal on voluntary basis

I am writing to seek expert guidance on a very difficult ordeal a friend of mine has been put through: He is permanently resident in Germany but with an Indian passport, has just had a terrible ordeal with the UK Visa & Immigration Agency at Gatwick. On arrival, he met a very rude ECO at the des...

Re: 7 weeks - originals not returned, and still 'under proce

I am not sure what's going on - quite clear the OCI process is very different in UK, US, Australia - each of these high commissions appear to deviate from the norm with their document requirements, number of copies requested of applications etc. what is uniform is the poor service from VFS who have ...

Re: 7 weeks - originals not returned, and still 'under proce

Yes there is a U-sticker on the passports. We have finally got our British Passports returned (with U-sticker affixed), and the OCI booklets. Have to say response from the CGI Birmingham was excellent (on email, within 10 hours or less) They followed up our requests for information and action with t...

Re: 7 weeks - originals not returned, and still 'under proce

Thank you for your suggestion. To my surprise, the document has been despatched from Delhi to Birmingham the next day (not incurring the several days delay many forum members have been reporting) so I expect to visit VFS Birmingham this week when it arrives. I hope it will then take 2-3 days to be a...

Re: 7 weeks - originals not returned, and still 'under proce

I called and sent several emails to VFS London and Birmingham and got stock responses that any applicant would know, no factual information or clarity. At 8 weeks, I called and sent emails to HCI London and CGI Birmingham who very very professional and responsive. No apologies per se but 1. my origi...

7 weeks - originals not returned, and still 'under process'

I applied for an OCI card on the 24th April 2015 at the VFS Birmingham for self and family (spouse an two children under 12) It was a straightforward process and there was no issue. Now 7 weeks later, I have not received my original documents back; and the online enquiry shows 'Under Process' VFS he...

Implications of the Tier 2 visa proposals to MAC

The UK Government has announced on 10 June that it intends to tighten rules on non-EU skilled migrants - these focus on Tier 2 (General) and Tier 2 (ICT) routes. David Cameron has advised the Migration Advisory Committee (MAC) of some of its proposals for further consideration. Noticed that there is...

Re: break in continuity 5yrs(refusal on Maintenance funds on

The UKVI respond to clear instructions, especially where backed up by a CC to your local MP. AFTER I was granted the correct visa, I wrote to the same team to regularise the gap citing that I needed this letter during application for ILR to show there was no gap is visa conditions since XXXX (year)...

Application date for BC

What is the official application date for British Citizenship? I believe it is different from PBS applications (that tend to be post-stamped date) I applied for BC on 23-Oct-13 via NCS, advised the NCS officer i had been out of the country between 06-08 Nov 2008 so i hoped the application would be ...

Is UK-born son eligible for OCI card? [previously Indian]

My son has previously held an Indian passport [though born in the UK] but is now a BC. If both parents hold BC and are eligible for OCI, can he also apply for OCI card or must he apply for a PIO card only?

Our preference is the OCI card.

Thank you.

Can my minor daughter who has ILR for over 12 months (born in India in 2002) proceed to British citizenship in her own right or must one or both parents be British / apply

UPDATE: can minor daughter get BC if both parents have ILR?

If both parents have ILR but do not wish to become BC at this time, can my daughter born in India, now with ILR in her own right for over 12 months, proceed to BC? It was suggested to me she can't until at least one parent gains BC. [This is un-related to my son who has now received his British Pass...
