Just got a question myself, say my job title is not on COP, and there are two job titles on COP that are close to mine, A and B. However my current salary is only higher than A not B, so obviously I would use A in my application. Will UKBA then try to say actually B fits better, and because it's hig...

@York123 For your criminal record problem, I think since discretion was given for citizenship application, there is no reason why it shouldn't be given for ILR. Yes, it's not announce yet, but I think there must be a lot of people and interest group pushing for it. For your concern that the updated ...

Ryco1200, The thing with COP is, it has only a handful of job titles in it, even if one of the job title in COP is exactly the same as yours, it doesn't mean that you are doing the same thing that's intended by the COP, let alone a lot of people here having a job title that's not even on it. For exa...

York, forget about all the statement and news clips, it's very clear already if you just follow the rules and the change of rules itself. Assuming you are on a 5-year WP as I gathered, all you need to do to get ILR (apart from the old rules and criminality rules), is to match your current salary to ...

Hi Ksenia,

I hope you still remember the exact time you called UKBA as you described, and the name of the lady you talked to, because when she talks to you, she represents the government, everything she said will count.

ALI74, your situation is really bad, I'd suggest you find a lawyer as soon as possible.

Since the list is arbitrary, I think there is still chance to have it overturned, after all, we are just about coming out of a recession, it is not reasonable to expect anyone to have a pay rise every year.

not if it's a small change, but if you have a 50% pay rise, then questions will be asked. But as I read through other people's experience, when 5-year WP holders apply for ILR, P60 is not required (because your employer's letter would already certify that you have worked for them for continuously 5 ...

ALI74, read the Change 10 on page 6 on this, http://www.ukba.homeoffice.gov.uk/sitecontent/documents/policyandlaw/statementsofchanges/2011/hc863.pdf?view=Binary It says: delete paragraph 134(iv) and substitute: ...... basically the income requirement. people, you are takingathis all wrong. Salary level requirements WILL NOT AFFECT current WP holders for the purposes of ILR or extension. Read paragraphs 77 -79 of the Statement of Changes Not sure what are you refering to as paragraphs 77-79. If you mean paragraphs 77-79 in all the changes, then t...

Even I have these doubts about salary criteria.. We dont have any salary criteria when we got work permit. And also i dont know from how many days we need to show this salary. Yes, we don't have salary criteria but when our employer applied WP for us there is a stated salary or expected salary on y...

So am I right to say: since it's down to employer to certify your job title when applying for ILR after 5-years WP, with the job title on my WP documents not on that list, it's possible to choose one that's on the list and not far off from what I am doing and most importantly, with a low salary req...

put it this way... does "work permit" plus current "tier 2" equals 5 years in 2012? the reason it might not cover 5 year period might be that you took up employment few months after your visa was granted so in theory you got 5-year visa but u havent lived for 5 years! hence not ...

Why April?

All the new immigration rules brought in by the new government, like changes to Tier1 & 2, the permanent cap and potential changes to Tier 4 will all come in to force in April 2011. Just wondering why April? Why not March or January? And does this mean after these changes this April, any future ...

There is some change on UKBA website again http://www.ukba.homeoffice.gov.uk/sitecontent/newsfragments/35-t1-t2-annual-limits It now says Skilled and highly skilled migrants will need to meet the salary criteria that applied when they last extended their permission to stay. What was the salary crite...

Salary for Workpermit holder

A bit worried about the new rules stating: Tier 1 and Tier 2 migrants applying for settlement will need to meet the salary criteria that applied when they last extended their permission to stay. Right now, 4 years into my 5-year work permit, my salary is barely above the salary stated on my original...

What's the salary requirement for the old style Workpermit?

I got my WP dec 2006, but can't remember what's the requirement at the time, now that according to http://www.ukba.homeoffice.gov.uk/sitec ... ual-limits, I'll need to meet the salary requirement at the time of my application to get my ILR a year from now.
Thanks

Just had an idea, since none of us is psychic, the only way to know what's gonna happen to the various categories of visa you are holding right now is to contact your MP, it's time they do something for a change, like replying your email.

I won't be surprised if they scrap PSW all together, after all, it's only introduced 5-6 years ago "to attract foreign students", now that they don't want to attract anybody anymore, scrapping it would be only reasonable. My solicitor said once that the 5-year-rule for Tier 1 & 2 won't...

On UKBA's website, there is a page listing all the kinds of visa that could eventually lead to PR, it did say the number of years needed before applying for PR may subject to change (possible but highly unlikely because of the restriction from European directive), but the expectation those that alr...

But PSW and ICT categories do not lead to settlement so there is nothing to break the link If you ask me, I'd say that's the whole point. She said all this in a speech, it's all about sound-bite, do you think the British public would understand all this details? No they don't, all they need to hear...
