How to ascertain "first time deception was used"?

This one is a little technical so please bear with me! Under s.320 the applicant must be refused UK visa automatically for 10 years if he used deception in support of his application. The letter of refusal of this gentelman specifically states that the visa may be refused automatically for 10 years ...

Thnx Vinnie but in this tcase the defendant did not have 14 years in the UK facts are slightly different . [KB (para: 320(7A): "false representations") Albania [2009] UKAIT 00043 (02 October 2009)]. It seems to me that the HO only react if these guys appeal against a HO's decision of any k...

Yes but these guys alleged discrimination on grounds of raceand all sorts of things well before the war started so the time period is not an issue, the important thing is that they claimed they were Albanians from Kosovo rather than from Albania!

The 14 year rule

Dear all I was wondering if anyone knows how strict is the HO in applying the 14 year rule for Albanian nationals who obtained British Citizenship by fraudulently claiming that they were Kosovans during the Kosovo war?! I know the HO started deprivation proceedings against the ones who had less than...

Right to appeal if banned from entering the UK for 10 years

Does anyone know if someone has a right to appeal the visa refusal if banned from entering the UK for 10 years. In other words, if someone has been refused UK visa for 10 years on grounds of false representations and decides to apply again within the 10 year ban period but sponsored from a different...

Thanks Vinny, I was aware of the law. I was just wondering whether anyone knows how it works in practice in other words do the entry clearance officers have any discretion to grant the visa or it will be automatically refused?

Thanks

Is there discretion on 10 years automatic refusal

Once one has been refused visa and warned with 10 years automatic refusal, does it mean that the person will automatically be refused visa in the next 10 years or there is still some discretion on granting the visa?!

Thnak you

Application for a Visa to Republic of Ireland

Hello everybody Does anyone know where one can apply for a visa to the Republic of Ireland if there is no Irish embassy in the country the applicant comes from? My ex from Montenegro wants to visit Ireland but there is no Irish embassy in Montenegro and she has no clue where to apply. Thank you in a...

Vinny, Apparently, Serbians are non-visa nationals, as Serbia is not listed in Appendix 1 - Visa requirements for the United Kingdom. So visitors may apply for leave to enter at the UK border. is not true because of Serbia's past: Vietnam Yemen Zambia Zimbabwe The territories formerly comprising th...

I cannot be sure, that's what he tells me! He said that since his son's been in the UK for over 14 years they won't commence deprivation proceedings. So far he has not heard anything but God knows!!! He said that someone in the same position had been asked to return the passport but after his solici...

Thanx again Vinnie Just for information, his son won't face any problems as he's been in this country well over 14 years and I'm familiar with the case you cited but the last question I had, can you request the ban to be lifted and will it be taken into consideration at all? My friend did not want t...

Thnx Vinnie, He didn't do anything really, he's 61 years old! He has come to the UK 5 times previously invited by his son who had falsily claimed that he was from Kosovo rather than Albania and got British citizenship. On each ocassion he has declared the true nationality of his son to the British e...

Thank you Vinnie, I think your reply clarifies the issue. Since Serbia is not on the list it means that they may get the visa at the UK border, subject to the person travelling having a biometric passport. At least this is how I read. I would be grateful if you could clarify something else for me if...

Hi Vinnie

Thank you for the reply, I have already checked it but it doesn't really say much. I was actually looking to hear from someone who has applied so if there is any Serbians or Maqedonians out there I would be grateful if you could let me know.

Thank you.

UK visas for Serbians-on UK border or British Embassy?

Hello everybody, Does any one know where Serbian citizens can get their UK visas? Is it the British embassy in Belgrade or do they get them on the UK border. Serbia had the visa system for the Shengen countries abolished last year but I cannot get any info where they get the UK visas now. Thank you ...
