ok I just read some more of the thread on 'tightening the noose'.

it looks like if I apply < 3 month before expiry should give me the extension from my previous expiry date. which would meet my need for 5 years.

guess I'm going postal after all!

Just for curiosity, why are you migrating from Australia to UK? I mean in the UK Australia seems like a heaven and people are thinking to migrate to Australia since its economy is better and more pay / job opportunities. i think you should never mention it. In case if they refuse your visa you can still apeal it attaching your penalty receipt that you ve paid the amount before 21 days and its clearly mentioned in the recept that its not a criminal offence before that. Well...I just had a word with customer service ...

Normally, you may apply for ILR no sooner than 28 days prior to the completion of your qualifying period and before your leave expires. See also Chapter 6A - Settlement . 4. is applicable to naturalisation applications, not ILR applications. Thanks vinny. I read Chapter 6A and I can see the answers...

I think I found the answer to question 2.

It will be 5 years because I fall under the new PBS, and not the old HSMP.
So does that mean 180 days of absence in the 5 year period?

Also can someone help clarify the other points?
