Relevant income for UKBA purposes:

Self-employed - Net profit before tax = Income minus business expenses.

Dividend - Gross amount of dividend (i.e. without tax deduction)

Profit of Ltd company - Retained earnings within business before tax (after dividend)

contributory benefits (benefit linked to your NI) do NOT come under the definition of "public funds" hence doesn't cause breach of immigration rules.

Contributory benefits are of various types such as Maternity Allowance/SMP, SSP, Contribution based - JSA, NHS etc.

I think we are over complicating this issue. If UKBA is happy with NARIC's English Language Assessment based on a overseas degree than it's perfectly fine. Infect it's more objective evidence than getting a statement of comparability and college letter regarding medium of instruction as English........

For Tier 1 (General), there is no requirement to SHOW 5 year economic activity. All you have to meet is point requirement and relevent income in any 12 months of last 15 month.........You would have already provided first 2/3 earning proof at 1st extention.

It's not the first time I am hearing solicitor(s) giving wrong advice. You can surely get ILR for you UK born under 18 kids (regardless of their age) as soon as one of the parents get ILR.........I know a family who did this without any issue.
