I think these new rules are against the ECJ judgement in Akrich?
Its harsh that you have to sell your house in your home country in order to bring your family members to your home country. HO is full of idiots, what the hell they are thinking

I will advise people not to get too worried though. The 1972 act has precedence over the EEA Regulations. It permits the court to ignore the EEA regulations and implement the directive, where the regulations conflict with the caselaw and the directive. So the court will be bound by law to ignore th...

I think all potential Surinder Singh people, who will be applying for an EEA family permit or Residence Card after 01/01/2014, are best advised to seek legal advice on their position. I envisage a significant number of Refusal in the New year under this category. General adv...

It is possible/likely that it will be difficult to add her name to the Drugs Payment Scheme card, as it is an unusual thing to do because most people living in Ireland have a right to this in their own name. On the other hand, the staff in the office may just do it with no problem - it is impossibl...

Drug payment scheme - yes, definitely, this is one of your rights as an insured worked, and no penalty can be applied to her because you exercise this right. Medical card - definitely not, in my opinion, at the present time. If she gets a residence card she could apply afterwards, but it would be u...

Welcome back mate, it seems your 2 weeks holidays were extended to 2 months. :)
Thanks for the case law, i was struggling to find a case law that relates to dependent parents.
Is it worth mentioning this case law in the letter of application for residence card?

Thanks
