Discretion n gap in 10 year rule (out of time application)

Rather straightforward 10 year ILR application; 10 years on student visas from Apr 2002-Apr 2012, except the first student visa due to expire 21 Apr 2003, only discovered this on 1 May 2003 and called HO immediately, appointment made for same day service for 6 May and visa granted. This leaves me wi...

Else, from 23-04 to the date of issue of new leave.
Would you please clarify whether this actually breaks the residency?

He was granted leave on 06.05.2003. Now that is a 13 day gap. Would this break his 10 years?

short gap between applications (long residence)

I am submitting this query on behalf of a friend who does not have access to this forum. Basically, he has accumulated 10 years in the UK and wonders whether he had a break in 2003. His visa expired on 23.04.2003, which he didn't know, and only discovered this on 01.05.2003. He then contacted the ho...

Visitor status may be included under Long residence . However, a visitor applying for ILR may be refused under 322(7) because of 41(i) & (ii) , unless there was a relevant change in circumstances. Many thanks indeed for your reply. With regards to the 28 days rule, do I satisfy that with my dat...

ILR (10 year) or extension

I appreciate some advice on ILR 10 year rule. I have been on a student visa from 29.04.2002 until 15.05.2011. I left the UK on 15.05.2011 with the intention of coming back for my PhD viva. I am now in the UK on a student visitor visa which runs from 28.09.2011 - 28.03.2012. Will I qualify for 10 yea...

The rules state that you should not be outside the UK for a period of more than 6 months in one go, and that the total absences do not exceed 18 months in 10 years. 5 months outside the UK (particularly that you can demonstrate that you intended to come back) should not be a problem, as long as the ...

I was in the same boat last year. My student visa was refused in March 2010. I appealed, and this was allowed on 12 August 2010. I was due to complete 10 years in UK on 29 Sep 2010, so in theory I was entitled to apply for ILR on 03.09.2010, which is what I did. UKBA accepted my ILR application even...

ILR 10 year with 1 single gap

Hello everyone I wonder whether someone would be able to advise us. A friend of mine is due to apply for ILR under the long residence rules (8 years student + 2 years PSW). I won't bore you with all the details, but in 2006, he submitted an out-of-time application for his visa (visa expired 30.10.20...
