Re: overstayer with a 3months pregnant eea national

I believe the phrase "put to bed" indicates giving birth. I beg to differ. As a native English speaker 'put to bed' means to 'put aside' i.e. do whatever is necessary and forget about it. Implication is 'sort it and forget it...' in a slightly brutal way.... "Put to bed means "t...

Re: overstayer with a 3months pregnant eea national

[quote="Obie"]I believe the phrase "put to bed" indicates giving birth. I don't think a person is precluded from qualifying as a durable partner if the EEA national ' s is married to another person, provided of course the marriage is not subsisting. By subsisting, I am sure you w...

Re: overstayer with a 3months pregnant eea national

Hi there It's a bit complicated situation. Have you legally separated from your ex wife ? If no you will need to be legally devorced before your next wedding , as you have pending case with home office they may suspect your case. Although you don't need a legal status in the uk to marry a EEA natio...

Re: EEA4 fast processing times or wishful thinking

Hi Please just want to know if I will be given COA with right to work when I apply for my unmarried partner PR . Hi Toni34 On the assumption you have previously been issued a residence card ie EEA2 as an unmarried partner, you should have a COA with right to work when you apply for PR. Best wishes ...

Re: Eea 3 and 4 application and benefit

It was my husband receiving £7 WTC. I was self-sufficient relaying on my non EU husbands income from self-employment. We provided HO with my husbands bank statements (no bank transfers to my account, only showing his savings, income, expenses and WTC). We were refused. However we later applied fo my ...

Re: Eea 3 and 4 application and benefit

Ukba has link with benefits authority to check that but what I believe is that all such benefits an EU national worker can claim but in case of self sufficiency it may cause problem if these benefits has been claimed continuously for longer period. I also think in this case applying eea3 alone at f...

Re: Eea 3 and 4 application and benefit

I think you could probably get away with a few months but I don't think 2 years is going to work, I'm afraid. You can try an application without mentioning the benefits but there is no telling the outcome, as some caseworkers may refuse for the lack of information provided. I know my only hope is t...

Re: Eea 3 and 4 application and benefit

@toni34, how long have you been claiming Child Beneft and WTC? If it has been for only a short period out of the many years the EEA national has been living in the UK, I think it could be reasonably argued that the EEA national has not been a "burden" on the social assistance system. Abou...

Re: Eea 3 and 4 application and benefit

I am not expert but transferring funds into EU national regularly is a good practice for self suffiency but claiming WTC and child benefit continuously for longer time can be harmful (if caseworker trace it). You said if they traced it that was my point , I have csi and any every other documentatio...

Re: Eea 3 and 4 application and benefit

I'm afraid the Home Office has been known to be mean in your kind of situation. I remember someone being refused because of getting a low sum of working tax credit a week. I think the sum was £7. I think that's very unreasonable as I do not think that low sum could be argued to be a burden on the s...

Re: EEA3 in 27 days

Yes we had £7/week in tax credits while I was exercising Treaty rights as self-sufficient. If your Eea family member is working then its fine to receive public funds but not when self sufficient . We just tried our luck and and instead of appealing we sent the same bank statements along with ehic f...
