Just a few days ago, my Non-EU spouse, our two kids and myself who are brits returned to the UK from Portugal where we have been resident for the best part of two years. My spouse has an Article 10. EU family member residence card issued by the Portuguese authority. I decided I didn't want UK airpor...

Members only have the privilege of the PM facility after making 30 posts and until then messages will sit in the outbox. You now have 30 posts so this should be active. Messages will also sit in the outbox until read by the recipient. Thanks for the heads-up, I seem to remember sending PM's somewhe...

Re: EC 2004/38 based Visa Issued post brexit!

Hello guys, My family member have been issued a EC 2004/38 based short term visa from NON-EU country from the German embassy. Re: British, moving to Portugal with Indian spouse

When you arrive in Portugal you and your spouse would need to go along to the "Financas" or the local tax office with a proof of address and your ID to obtain a NIE number. Once you have that your NIE number, you the Brit should go to the local "Camara" or city hall with your ID,...

Re: Residence For Non-EEA Spouse Of a EU Citizen - Portugl

As you are married to an EU citizen you and your spouse are covered under the Freedom of Movement Directive 2004/38EC which governs the rights of EU citizens and their family members to move and reside freely in any EU member state. Therefore you would be welcome to move to Portugal, specifically yo...

Re: Spouse Visa rejected because of Marriage Certificate

The Czech embassy are well aware that the UK recognises any marriage entered into by a UK citizen abroad provided it is validly contracted and recognised under the laws of the country where the marriage takes place, the Czechs do this a lot, it is simply a means to frustrate you. Go the UK Embassy i...

Theoretically speaking once you are established in your new member state, your partner should be able to join you expeditiously. In actual fact, bearing in mind where your partner is coming from you are likely on a hiding to nothing, the EU embassies will frustrate your partner in Nigeria with your ...

@Walrusgrumble. We have tried getting information from the Irish Embassy, unfortunately we are refered to the outsourced visa application centre or their web-site. I run a small consultancy which would work just as well in ireland (fingers crossed). There's nothing for it but to give it a go and see...

[To answer your question. Here is what I believe the Czechs think. They are looking at Akrich (which yes was overruled substantially by Metock - Metock 2008 is very important for you) and believe that ye are trying to "abuse" EU law in order to get back to Britain via Czech Rep as the UK, ...

@Dalebutt and Walrusgrumble, legitimate questions, however for reasons i'd rather not go into, my preference is to have no dealings whatsoever with UK immigration under domestic rules, my family and I have been treated in an appalling manner. As a UK citizen born and bred i do expect a somewhat high...

Thanks for your comments dalebutt. I'm not quite sure getting a new passport helps since UK & Ireland share information with the Schengen countries, and not disclosing previous refusals by other countries is pretty much grounds for an automatic refusal. I do take on-board your points though.

Well, in theory going by the directive on freedom of movement you're good to go. In practice however...it's a different matter. If you married or are getting married in the UK with a UK registry issued marriage certificate then you should be fine, if you married or are going to get married outside o...

@Andal, sorry to read about your troubles with the Spanish Embassy, as has been pointed out to me by Sovit there is no legal basis under the EU directive for the spanish requirement of registering one's marriage with the member state of the EU citizen, it is simply a mis-transposition by the spanish...

UKBA's response to the Zambrano Judgement seems on course to be at par with the Danish response. It raises more questions than it answers, for instance, what is the remedy for a parent of a UK minor who actually has been removed from the country (erroneously as it transpires ) ? If UKBA does not con...

It appears i'd stand a better chance of making it across a minefield blindfold than getting a EU family member visa for my wife. Koded, thanks for your comments. I believe we are well within our rights to apply for a EU Schengen visa, the fact that renegade EU member states choose to circumvent or ignore the rules of the directive should not erode those rights. There is no requirement of prior residency in the host EU member ...
