I would suggest e-mailing UKBA and getting their response on record. Technically, as per the rule, PBS dependants must cchange to FLR(M) once the main applicant gets ILR. Your wife can apply for ILR same time as you (as she has been in UK for 2 yrs as your dependant).

The new rules do not apply to you (just make sure you meet the old rules that DO apply to you).

As they will not have completed 2 yeasr by Mar 2013, then must apply for FLR(M) when the main applicant gets ILR.

Per my consulation with solicitor, they will then come under the 5 year rule.

I think because your wife will be changing her visa status (from Tier 1 dependant to FLR(M) as opposed to extending her current visa she will be subject to new rules, e.g. waiting for 5 years before getting an ILR.

If your total UNPAID is greater than 180 it can be risky you would benefit from showing as much proof as possible that you maintained ties with UK. E.g. utility bills, council tax, bank statement showing rent being paid etc.
