If he has got his passport, he can return to uk as long as you're in UK. Permanent residence is only a confirmation of his right derived from you.

I doubt postage stamp, ink used to print and write on papers for correspondents will cost 300£.

If you take note of the table (valid until 05/04/12) it states- implemented date is TBC. However on the table (06/04/12) EEA is no where to be found. :)

I wish you the best with the rtwt.

Why don't you protect your interest by getting the Italian passport first and be free from this sort of restrictions or better still just travel for 6 months?

A lot of thing can happen in a week not to talk about 8-9months.

Have fun

There're some examples of self interest  here and that's one of the reason our world is upside down today. All we care about is what we want as an individual c'est tout! We should fight for collective interest of everyone. What makes you think ukba won't have better reasons to increase the fee yea...

Perhaps you or your wife should go to the relevant registry to registar your name as the father and get a new birth certificate.

Getting married makes think a lot easier as others suggested but I believe you've still got a good chance because you got children together.

I wish you all the best.

Yes you can marry in the UK
You can marry an asylum seeker
Once you're married, your spouse can withdraw his/her asylum application (but you don't have to, it just becomes irrelevant) and apply for residence card.

Either you or your wife can apply for it but your passport etc will be needed. You should include all the documents you can to show that your wife's son qualify for an EEA family permit. As a guide they should include:  a copy of your EEA national passport (endorsed by your embassy in the country o...

On this occasion over staying in your visa in UK hasn't got any bearing on your eea application when you apply to family permit or residence card.

I believe you and your wife don't have to have a job before you can apply for confirmation of residence as long as she's actively looking for job.

You don't apply for indefinite leave to remain (ILR), you'll have to apply for Permanent Residence (PR) towards the end of your current Residence Card (RC) or once it expired. You will also have to demonstrate that your EEA family member has been exercising treaty right in the 5 year period you hold...

He should apply for residence card without a passport and put into writing why he can't provide a passport together with he rc app. Although it's likely to be rejected, but the will send him a letter saying the reason why his app was rejected and request he gets a passport and re-apply. Hopefully th...

Hi guys, please feel free to contribute to this topic. In-case you haven't heard or seen this- ukba is to charge 300£ for eea applications. UKBA- 'There is no fee for applications made by post or in person at the moment under European law. We will be introducing a fee of £300 for applications made...

I'm not going to ask you to lie as some people may later suggest but my point is, there's no way the ukba will know whether your spouse or yourself has worked on tourist visa or not except they're extremely on to her case or you're caught red-handedly while working. As far as I'm concern there's no ...

Greenie made a good point. Rather than being in emotional wilderness in UK, people will definitely be happy and to go to their home country to apply for entry clearance if it's quick for everyone without being denailed for silly things. No, you don't have to tell them a thing.

Since you're now a european (EU national), you're not under any restriction.

You may wanna apply for registration certificate to confirm your right of residence in the uk. That is not to say you dont currently have the right to stay.

Of course they won't tell you to go back to your country. I believe they would have told you to re-apply when you've got all necessary documents in the letter returned with your app. They usually tell you what you need to send to them when you re-apply. You definitely need your wife's passport and p...
